5.98.010 Establishment.

The city of Wenatchee, by the ordinance codified in this chapter, establishes a parking and business improvement area bounded and described as set forth in WCC 5.98.020. (Ord. 2112 § 5, 1973)

5.98.020 Description.

The description and boundaries of such area are as follows: All those businesses within the area between Columbia Street and Chelan Street and bounded by Kittitas Street and Second Avenue. (Ord. 2112 § 3, 1973)

5.98.030 Assessment – Levy.

The annual additional rate or levy of special assessment to be imposed shall be based on a multiple applied against the business license paid by each business within the area and such classification of businesses and the multiple to be applied against each classification of business is set forth on Exhibit “A,” on file in the office of the city clerk and incorporated in this chapter by reference. 5.98.040 Assessment – Revenue disposition.

(1) The special assessment revenue collected pursuant to this chapter shall be utilized as follows:

(a) Eighty percent shall be applied to hourly, daily or monthly parking validations.

(b) Eleven percent shall be applied to maintenance and replacement of downtown Christmas decorations.

(c) Nine percent shall be utilized in the development of customer conveniences and landscaping within the area.

(2) The 80 percent devoted toward parking facilities shall be refunded to the businesses paying the same within the area in the form of parking coupons and/or stamps to be utilized by such businesses to provide parking for employees and/or customers on the following basis:

(a) Commercial lots may redeem monthly validation coupons once a month along with “Park N Shop” stamps being redeemed from the business improvement area.

(b) Private lots being utilized partially or totally for monthly off-street parking of employers or employees shall be reimbursed as follows:

(i) Credit as is specifically set forth on Exhibit “A” attached to the ordinance codified in this chapter and incorporated in this section by reference shall be allowed against the assessment established by this chapter.

(ii) Businesses providing authorized private monthly off-street parking lots for employers or employees of other businesses may redeem monthly parking coupons from the business improvement area commission limited to one coupon per authorized stall per month. 5.98.050 Parking and business improvement area commission.

There is appointed a commission to be known as parking and business improvement area commission consisting of seven members to be appointed upon motion of the city commission.

The parking and business improvement area commission is authorized to adopt rules and regulations for the administration of this chapter, which rules and regulations shall be valid upon approval of the city commission of the city of Wenatchee when adopted by resolution.

Any business, person, firm or corporation aggrieved by any decision of the parking and business improvement area commission may appeal that decision to the city commission of the city of Wenatchee, which appeal shall be de novo. (Ord. 2112 § 7, 1973)

5.98.060 Assessment – Collection.

The special assessment provided herein shall be collected on a fiscal year basis, the first fiscal year to commence on June 1, 1973. The special assessment provided herein shall be delinquent 30 days after June 1st. Such delinquent assessments shall bear interest at the rate of 12 percent per year. (Ord. 2112 § 9, 1973)

5.98.070 Administration contract authorization.

The mayor and the clerk are authorized and directed to execute a contract between the city of Wenatchee and the parking and business improvement area commission so as to authorize the parking and business improvement commission to administer the operation of the parking and business improvement area, including the administration of any funds derived pursuant thereto.
