8.02.002 Model Traffic Ordinance – Adopted by reference.

(1) The Washington Model Traffic Ordinance, Chapter 308-330 WAC, is hereby adopted by reference as the traffic ordinance of the city of Wenatchee as if set forth in full in this chapter.

(2) Sections Not Adopted. The following sections of the MTO are not adopted by reference and are expressly deleted: WAC 308-330-250, 308-330-500 through 308-330-540, and 308-330-560. (Ord. 3101 §§ 1, 2, 1994; Ord. 2293 § 1, 1977)

8.02.004 Drunk Driving Act adopted.

Chapter 275, Laws of 1994, Sections 4, 5, 6, 7, 10, 11, 12, and 23 be and hereby are adopted in their entirety as now or hereafter amended. (Ord. 3079 § 1, 1994)

8.02.005 Use of wireless communication devices.

RCW 46.61.667 and 46.61.668, as now or hereafter amended, are hereby adopted by reference as part of this chapter in all respects as though such sections were set forth in full herein. (Ord. 2010-12 § 1)

8.02.006 Disposition of traffic fines and forfeitures.

All fines or forfeitures collected upon conviction or upon the forfeiture of bail of any person charged with a violation of any of the provisions of the traffic ordinance of the city as adopted by WCC 8.02.002 shall be paid into the general fund of the city. (Ord. 2293 § 3, 1977)

8.02.008 Official misconduct.

Failure, refusal, or neglect on the part of any judicial or other officer or employee receiving or having custody of any fine or forfeiture of bail as provided in WCC 8.02.006, either before or after a deposit in the general fund, to comply with the provisions of WCC 8.02.006 shall constitute misconduct in office and shall be grounds for removal therefrom, provided appropriate removal action is taken pursuant to state law relating to removal of public officials. 8.02.010 Filing of adopted statutes required.

Incident to the adoption of the MTO by reference by WCC 8.02.002, copies of the text of the adopted MTO and of other adopted statutes shall be filed as required by RCW 35A.12.140 for use and examination by the public. (Ord. 2293 § 5, 1977)

8.02.020 Manual on Uniform Traffic Control Devices for Streets and Highways adopted.

Repealed by Ord. 2005-09. (Ord. 2194 § 3, 1975)

8.02.030 Speed limit – Generally.

Subject to the provisions of WCC 8.02.020 and 8.02.040, it is unlawful for the operator of any vehicle to operate the same at a speed in excess of 25 miles per hour when operating any vehicle upon a public street within the city limits of the city of Wenatchee. (Ord. 2194 § 4, 1975)

8.02.040 Speed limit – Designated streets.

The speed limit for operation of a vehicle on the following designated streets is hereby respectively established as:

Washington Street from a point 150 feet west of King Street to Western Avenue.

That portion of Chelan Avenue from Miller Street to Mission Street that is part of the State Highway System.

Orondo Avenue from Cherry Street to Chelan Avenue.

Worthen Street from the Thurston Street underpass to a point 1,100 feet south of Fifth Street.

 

Easy Street from Olds Station Road to the north city limits.

 

Penny Road from Easy Street to Euclid Avenue.

 

Euclid Avenue from Penny Road to SR 2/97.

8.02.050 Speed limit – Alleys – Violation.

(1) It is unlawful for the operator of any vehicle to operate the same at a speed in excess of 10 miles per hour when operating any vehicle upon an alley within the city limits of the city of Wenatchee, unless otherwise designated.

(2) Every person committing a violation of the provisions of subsection (1) of this section has committed a traffic infraction and shall be penalized pursuant to the monetary penalty schedule provided for in Justice Court Traffic Infraction Rule 6.2(d). The amendment or repeal of any provision of Justice Court Traffic Infraction Rule 6.2(d) shall automatically amend or repeal that portion of this section. (Ord. 2548 §§ 1, 2, 1984)

8.02.060 Towing fees.

(1) Pursuant to RCW 35.21.180, and the authority extended thereby, the city of Wenatchee does hereby adopt by reference WAC 204-91A-140, together with amendments thereto or additions thereto on the subject of this section.

(2) One copy of WAC 204-91A-140, which is attached to the ordinance codified in this section and incorporated herein by reference, shall be filed with the city clerk for use and examination by the public prior to the adoption of said WAC 204-91A-140. (Ord. 97-16 §§ 1, 2)
