HEATING CONTRACTORS AND INSTALLATIONS

5.24.010 License – Required.

It is unlawful for any person, firm or corporation to engage in, conduct or carry on the business of installing furnaces or other heating apparatus in any residence or business establishment without having an unrevoked, unsuspended and unexpired license so to do issued by the city clerk/treasurer for the city in accordance with the provisions hereof. The license required under this chapter is separate from and in addition to the business license issued under Chapter 5.04 ZMC, which may also be required when applicable. 5.24.020 License – Expiration – Fee.

All such licenses shall expire on the thirty-first day of December following the date of their issue, and the fee for such license shall be $25.00. (Ord. 313 § 1, 1965)

5.24.030 License – Application.

Application for such license shall be made in writing to the city clerk/treasurer for the city, accompanied by the required fee, and shall state the name and address of the applicant, and in the case of firms the names of the individuals composing the firm, and in the case of corporations the name of the managing officials thereof, and shall state the location of the place of business of the applicant, and the name under which such business is conducted. Such a license shall grant to the holder thereof the right to engage in, conduct or carry on the business of installing furnaces or other heating equipment in any and all places within the city. 5.24.040 Bond.

The application for such license shall be accompanied by a bond in the penal sum of $1,000 with the city named as obligee therein, with good and sufficient surety to be approved by the city mayor. Said bond shall at all times be kept in full force and effect, and any cancellation or revocation thereof, or withdrawal of the surety therefrom, shall ipso facto revoke and suspend the license issued to the principal until such time as a new bond of like tenor and effect shall have been filed and approved as herein provided. Upon approval of said bond by the city mayor, the city clerk/treasurer shall issue the license herein provided for. Said bond shall be conditioned that in any installation of a furnace or other heating equipment the principal shall install the same in a safe and proper manner. Said bond shall be further conditioned that the principal will pay for all labor and materials furnished or used upon such work, and all damages that may be sustained by any person, firm or corporation due to a failure of the principal to make such installation in a safe and proper manner. 5.24.050 Violation – Penalty.

Any person, firm or corporation violating any provisions of this chapter shall be guilty of a misdemeanor and shall be punishable by a fine of not more than $100.00 or imprisonment for not more than 30 days, or both such fine and imprisonment. (Ord. 313 § 2, 1965)
