TRUCK AND BUS OPERATION AND PARKING REGULATIONS

10.50.010 Parking of buses, trucks, truck tractors, truck trailers or truck semi-trailer combinations on public street or right-of-way.

No person shall park a truck, truck tractor, truck trailer, bus, or truck semi-trailer combination, weighing over 15,000 pounds licensed gross weight, upon any public street or public right-of-way, except temporarily for the purpose of making a pick-up or delivery of goods, materials, equipment, or persons, or for the purpose of allowing an operator or passenger to make a brief rest stop, lasting no more than one hour. Gross weight shall be computed in accordance with RCW 46.16.111, as amended, which section is incorporated herein by this reference. (Ord. 1489 § 1, 2019)

10.50.020 Operation of vehicles on designated truck routes.

No person or corporation shall operate a truck, truck tractor, truck trailer, bus, or truck tractor and semi-trailer combination over eight feet in width, over 15 feet in length, and over 15,000 pounds licensed gross weight on any street or public right-of-way in the city which is not designated as a truck route in ZMC 10.50.050, except that:

A. School buses, emergency vehicles, public utility vehicles, and solid waste disposal vehicles are exempt from this section;

B. Any truck or combination of truck and trailer may travel via the most direct route to another location within the city for the exclusive purpose of pick-up or delivery, or emergency repair;

C. Any truck may be driven via the most direct route possible from a truck route to the place of business or residence of the driver in the city; provided, that any such truck shall be parked off the public right-of-way. (Ord. 1489 § 1, 2019)

10.50.030 Hazardous materials.

A. Hazardous materials are those materials defined as dangerous wastes, per RCW 70.105.010, as amended, including “extremely hazardous waste” as defined therein, and those materials defined as hazardous substances or hazardous materials by RCW 70.102.010, as amended, and includes those substances or materials identified as such under regulations or guidelines adopted by the State Department of Ecology, or under regulations adopted pursuant to the Federal Hazardous Materials Transportation Act, the Resource Conservation and Recovery Act, the Comprehensive Environmental Response Compensation and Liability Act, the Federal Insecticide, Fungicide and Rodenticide Act, the Occupational Safety and Health Act hazard communication standards, and the State Hazardous Waste Act, and includes substances composed of radioactive components or both radioactive and hazardous components, and which are regulated by the State Department of Ecology.

B. All vehicles transporting hazardous materials shall be restricted to the state highway system or to one of the designated truck routes while traveling to and from locations within the city limits of the city. (Ord. 1489 § 1, 2019)

10.50.040 Penalties.

Any person violating this chapter shall be guilty of a civil infraction and upon conviction thereof shall be fined not more than $250.00 for the first offense and $500.00 for each additional offense. Each time a vehicle is used contrary to this chapter, such occasion shall constitute a separate offense within the meaning of this chapter. (Ord. 1489 § 1, 2019)

10.50.050 Truck routes.

A. Route Number 1.

1. East – From the corporate city limits beginning in the 10 block of 1st Avenue to the end of corporate city limits in the 1600 block of 1st Avenue.

2. West – From the incorporated city limits beginning in the 1600 block of 1st Avenue to the end of corporate city limits in the 10 block of 1st Avenue.

B. Route Number 2.

1. North – Cheyne Road northbound from 1st Avenue to the corporate city limits ending at Cheyne Road and Yakima Valley Highway.

2. South – From the corporate city limits at Cheyne Road and Yakima Valley Highway southbound to 1st Avenue. (Ord. 1489 § 1, 2019)
