2.70.010 Commission established.

There is hereby created and established a commission to be entitled and designated as the Transportation Commission. (Ord. 1412, § 2, March 5, 2024.)

2.70.020 Responsibilities and duties.

Under the direction of the City Council, the Commission’s responsibilities and duties include:

(1) Assisting with and advising on research, development and implementation of coordinated transportation programs to meet local needs and promote all modes of transportation.

(2) Acting in an advisory capacity to the City Council and City staff in the coordination of transportation-related safety activities, plans and programs of the City.

(3) Upon request, providing research and furnishing information to the City Council, the Planning Commission and other agencies and city departments.

(4) Promoting public acceptance of multimodal transportation programs proposed or initiated by the City, to foster public knowledge in support of all transportation modes, enforcement of relevant statutes and ordinances, and engineered solutions to transportation issues.

(5) Working with administration, staff and faculty of local schools to promote pedestrian, bicycle and traffic safety programs for students and their families.

(6) Promoting the education of the public on transportation safety matters and generally to assist in the overall reduction of transportation accidents, injuries and deaths, and facilitate the safe movement of users of the transportation system using all transportation modes upon the public rights-of-way of the City, including streets, sidewalks, and bike lanes.

(7) Performing such other duties and responsibilities relating to transportation within and affecting the users of the transportation system as the City Council may, from time to time, direct. (Ord. 1412, § 2, March 5, 2024.)

2.70.030 Membership.

The Commission shall consist of five members appointed by the Mayor and approved by the City Council. At least four of the members shall be residents of the City at the time of their nomination, appointment, and at all times during their tenure in office. A nonresident member may be appointed and approved when the Mayor and City Council determine that such individual has special qualifications and expertise in the subject matter of the Commission and has expressed interest in being appointed and serving and advancing the interests of the City. 2.70.040 Term of office.

The term of office shall be three years. (Ord. 1412, § 2, March 5, 2024.)

2.70.050 Vacancies and removals.

Any vacancies among the members shall be filled by appointment by the Mayor with approval by the Council. Any member may be removed for cause. A member of the Commission who is absent from three consecutive meetings without an excuse approved by the Commission is presumed to be in nonperformance of duty and the City Council may declare the position vacant and appoint or direct the appointment of a new member to fill the unexpired term. 2.70.060 Officers.

The Commission, at its first meeting on or after July 1st, each year, shall select one member to be the chair, another to be vice-chair and another to be secretary. The chair shall preside over the meetings of the Commission and perform such other duties as may be delegated by the Commission. The vice-chair shall act in the absence of the chair. The secretary shall take and prepare the minutes of the Commission in accordance with ORS 192.610 through 192.650. The secretary shall forward to the City Recorder, quarterly, a copy of the minutes of the meetings of the Commission. The secretary shall keep all the records of the Commission and shall perform such other duties as may be delegated by the Commission. The secretarial duties may be delegated to staff. 2.70.070 Meetings.

The Commission shall meet not less frequently than once per calendar quarter, at times and dates to be set by rule of the Commission, and may meet upon the call of the chair or on call by a majority of its members, the City Council, the Mayor or the City Manager. If necessary, members may attend the meeting by telephone or electronic communication in accordance with ORS 192.670. (Ord. 1412, § 2, March 5, 2024.)

2.70.080 Procedures.

The Commission’s procedures shall be in accordance with Robert’s Rules of Order. The Commission may adopt supplementary rules of procedure. All meetings are subject to the requirements of the Oregon Public Meetings Law (ORS 192.610 to 192.690). The agenda shall be set by the chair in consultation with staff appointed to support the commission pursuant to MCC 2.70.100. The chair may delegate the setting of the agenda to a staff member appointed to support the Commission. A majority of the members of the Commission shall constitute a quorum for the conduct of business and the concurrence of a majority of those members present shall be required to decide any matter. If the Commission is unable, because of a lack of a quorum or other cause, to act or make a recommendation on any matter before it in a timely manner, the City Council may act on the matter directly. 2.70.090 Council liaison.

The Mayor shall appoint a Council liaison to the Commission. It shall be the responsibility of the Council liaison to attend the meetings of the Commission, report on actions taken and facilitate communication between the Commission and the City Council. The Council liaison is not a member of the Commission, shall not count toward the quorum requirement of the Commission and shall not have a vote on any Commission action. 2.70.100 Staff support.

The City Manager shall assign staff to the Commission. Staff’s responsibility shall be to give the Commission neutral guidance and answer any questions of the Commission members. The staff person is not a member of the Commission. (Ord. 1412, § 2, March 5, 2024.)
