18.50.010 Purpose and intent.

The purpose of the business park (BP) zone is to provide for those commercial and industrial developments which are compatible with and supportive of the municipal airport in conformance with the comprehensive plan of the city, including: aviation design, construction, and support services; research and development activities; light manufacturing uses having no objectionable or obnoxious effect on adjacent properties including the municipal airport; warehousing and wholesaling uses; and those commercial services and retail activities which are consistent with the municipal airport and its business park setting and not reliant upon major street exposure for customers. Development of properties in a planned business park environment is encouraged.

A. The performance standards of the BP zone are intended to provide compatibility with and protection to surrounding properties, including the municipal airport, by minimizing traffic congestion, noise, glare, vibration, odors, airborne particulate and toxic substances.

B. The development standards of the BP zone are intended to result in a clean, quiet business park environment to accommodate uses operating substantially in enclosed buildings.

C. Developments in the BP zone are intended to be characterized by landscaped grounds, attractive buildings, and an aesthetically pleasing working environment.

D. General characteristics of the BP zone are intended to include paved roads and sidewalks, public sewer and water, a full line of public services and, if made available in the future, public transit accessibility. (Ord. 722 § 105, 1998; Ord. 634 § 1, 1993)

18.50.020 Permitted uses.

A. The following uses shall be permitted in the business park (BP) zone:

1. Business and professional offices, research facility, including development and testing, trade school;

2. Product assembly, light, i.e., sign manufacturing and repair, upholstery covering, electrical component manufacturing and assembly, garment manufacturing, pharmaceutical manufacturing, prefabrication construction including sale, woodworking, cabinet shop and other similar assembly processes;

3. Bakery, wholesale, distribution center for home delivery;

4. Bottling, brewery, winery and/or distillery;

5. Warehousing, wholesaling;

6. Printing, publishing, blueprinting, photostating, xerographic shop, newspaper production;

7. Storage facilities, indoor;

8. Fire station;

9. Public utility transmission facility, subject to subsection C of this section;

10. Aviation design, construction, storage, and support services;

11. Contractors’ construction services including, but not limited to, electrical, masonry, tile, plastering, carpentry, roofing, glass, insulation, plumbing, heating and ventilation, window screens and awnings, and similar services;

12. Repair services including, but not limited to, electrical appliance and motor repair, tool sharpening and repair;

13. Commercial services including, but not limited to, cleaning and janitorial, exterminating, linen supply, moving and storage, parcel delivery and pick-up;

14. Veterinary offices and clinics, which may include outdoor stalls for the treatment of large animals;

15. Brewery, winery or distillery, including tasting rooms and related sales provided the proposed establishment is not closer than 500 feet from any church, school, or public park or playground;

16. Restaurants, taverns, nightclubs and drive-in restaurants;

17. Other uses which the planning commission and city council determine to be similar in nature, function, and operation to listed permitted uses within this zone.

B. All such uses shall be within an enclosed building unless specifically stated otherwise.

C. In addition, the following specific standards are required for the following permitted use:

1. Public utility transmission facility; provided, that:

a. The utility company shall secure the necessary property or right-of-way to assure for the proper construction, continued maintenance, and general safety to the properties adjoining the public utility transmission facility;

b. All support structures for electrical transmission lines shall have their means of access located a minimum of 10 feet above the ground;

c. The facilities shall be compatible with the surrounding uses either by distance, landscaping, buffering, or design as determined by the community services director; and

d. The height of the structure above ground does not exceed 125 feet or requirements as may be imposed by FAA regulations governing height in proximity to an airport. (Ord. 947 § 2, 2014; Ord. 734 § 1, 1999; Ord. 722 § 106, 1998; Ord. 634 § 1, 1993)

18.50.030 Accessory uses.

All accessory uses, buildings and structures ordinarily appurtenant to any of the uses allowed in this zone are permitted. (Ord. 634 § 1, 1993)

18.50.040 Conditional uses.

The following conditional uses may be permitted within the BP zone through the granting of a conditional use permit:

A. Day care center in connection with a permitted use;

B. Post office, public parks, playgrounds and fairgrounds;

C. Outdoor storage not otherwise permitted in this chapter;

D. Animal shelter or commercial animal kennel;

E. Industrial uses and services not encompassed within the parameters of DPMC 18.50.020. (Ord. 947 § 3, 2014: Ord. 722 § 107, 1998; Ord. 634 § 1, 1993)

18.50.050 Prohibited uses.

All uses not specifically authorized in DPMC 18.50.020 are prohibited, including, but not limited to, the following:

A. General residential use;

B. General commercial use, except as specifically permitted in this chapter;

C. General public and semi-public use except as provided for in this chapter;

D. General agriculture use. (Ord. 722 § 108, 1998; Ord. 634 § 1, 1993)

18.50.060 Minimum lot area and minimum frontage.

The minimum lot area for uses in the BP zone shall be one acre of usable land with a minimum width of 150 feet at the front lot line. Minimum continuous frontage on a public road or street for each lot or parcel shall be 150 feet. (Ord. 722 § 109, 1998; Ord. 634 § 1, 1993)

18.50.070 Minimum yards.

The minimum yards and setbacks for uses in the BP zone shall be:

A. Front Yard. Fifty feet from the front lot line adjacent to a highway, major or secondary arterial, or other public streets;

B. Side Yard. Five feet from each side lot line; provided, that when adjacent to any residential zoning district or existing residential development, said side yard shall be a minimum of 50 feet;

C. Flanking Street Yard. Fifty feet from a side lot line adjacent to any public street; and

D. Rear Yard. Fifteen feet from the rear line; provided, that when adjacent to any residential zoning district or existing residential development, said rear yard shall be a minimum of 50 feet;

E. Exception. Side and rear yards adjacent to a residential zoning district or existing residential development may be reduced to a minimum of 25 feet if a solid wooden fence or solid decorative masonry wall, six feet in height, is erected along the side or rear lot line, or if an earthen landscaped berm, with a berm height of six feet excluding planting, is erected along such side or rear lot line. 18.50.080 Maximum building coverage.

Buildings in the BP zone shall cover no more than 50 percent of the lot area. (Ord. 722 § 111, 1998; Ord. 634 § 1, 1993)

18.50.090 Building height.

Building height in the BP zone shall be as required per DPMC 18.48.050. (Ord. 947 § 4, 2014: Ord. 722 § 112, 1998; Ord. 634 § 1, 1993)

18.50.100 Parking, loading and access standards.

A. Parking and loading standards for uses in the BP zone shall be as provided in Chapter 18.74 DPMC; provided, that all loading or unloading areas and facilities shall be screened from view from adjoining public streets by building design features, fencing or landscaping per DPMC 18.74.110.

B. If properties are to be developed in a planned business park environment with its own planned interior street system, access to individual parcels within such planned business park shall be provided from the interior street system. (Ord. 722 § 113, 1998; Ord. 634 § 1, 1993)

18.50.120 Landscaping standards.

Landscaping shall be provided as set forth in DPMC 18.74.110 and shall cover at least 10 percent of the total site area. (Ord. 634 § 1, 1993)

18.50.130 Storage standards.

Finished products may be stored within the back one-half of the lot when completely and totally screened from view beyond the property lines and adjacent streets by a minimum six-foot-high solid concrete or masonry wall or solid wood fence. Such solid fence or wall shall be constructed of the same architectural style throughout the area of development whether within a planned business park or developed independently. Storage of unfinished (or raw materials) products shall be in an enclosed building. Storage shall not project over or above the wall or fence, and the wall or fence shall comply with requirements for yard setbacks set forth in DPMC 18.50.070. Any wall or fence constructed shall conform with the “clear view triangle” requirements of Chapter 18.94 DPMC. As an alternative to a fence or wall, the city may permit one of the following: planting of a solid evergreen hedge at least six feet in height (such as green arborvitae shrubs); installation of a landscaped berm with the berm being a minimum of six feet in height; or development of a combination landscaped earthen berm topped with a solid evergreen hedge having a combined total minimum height of at least six feet; plus the storage height provisions cited herein shall apply, and the provisions of the other DPMC provisions cited herein shall also apply. 18.50.140 Refuse storage.

All outdoor trash, garbage, and refuse storage areas shall be screened on all sides from public view and, at a minimum, shall be enclosed on three sides with a six-foot-high concrete block or masonry wall, or a solid fence, with a solid gate for access installed on the fourth side. 18.50.150 Mechanical equipment.

All rooftop mechanical equipment shall be completely enclosed on all sides or shall be placed behind a permanent screen, restricted from view from any public right-of-way. (Ord. 722 § 117, 1998; Ord. 634 § 1, 1993)

18.50.160 Utilities.

All utilities, including sprinkler systems, shall be underground, with the exception of lighting fixtures. All wastes that would otherwise not be accepted by the City of Deer Park treatment plant must be pretreated per Spokane County health district standards. All lots shall hook up to the city sewer and water system when developed. (Ord. 634 § 1, 1993)

18.50.170 Lighting.

All lighting of the building, landscaping, parking lot, or similar facilities shall be designed to direct the light away from adjoining properties. (Ord. 634 § 1, 1993)

18.50.180 Environment.

All uses in the BP zone shall not emit obnoxious odors of any kind, or exhaust waste into the air or create dust by commercial or industrial operations on or adjacent to the site. All uses must meet requirements of the Spokane County air pollution control authority. All uses shall not operate in any manner that would produce heat or glare perceptible from any property line of the site on which the commercial or industrial operation is located, create any electrical disturbance off the site, or produce noise in excess of the standards identified in Chapter 173-60 WAC as measured from any residential property adjacent to the site on which the commercial or industrial operation is located.
