OPEN BURNING

8.36.010 Burning regulated.

A.    Except as hereinafter provided, no person shall burn, or cause to be burned, the following:

1.    Garbage;

2.    Any material liberating a toxic substance or combustion, or producing a noxious odor or creating a health hazard;

3.    Flammable liquids or other materials which create a fire hazard;

4.    Open areas of standing grass, woods, brush or similar materials;

5.    Combustibles in an amount exceeding two feet in height and five feet in diameter.

B.    No burning shall be allowed between seven p.m. and eight a.m., and all fires must be completely extinguished by seven p.m. No open burning shall be allowed when the wind velocity exceeds fifteen (15) miles per hour.

C.    Burning shall be permitted only on Tuesdays, Thursdays and Saturdays. Burning in ditches or on roadways is prohibited.

D.    The fire chief is authorized to issue written permits on forms provided by the fire department for fires otherwise prohibited by subsections (A)(3), (4) and (5) of this section, and to impose such additional conditions and requirements as he deems necessary for the public safety and welfare. The fire chief may refuse such permit completely if he or she concludes the proposed burning would be hazardous, unsafe or otherwise harmful.

E.    Permits shall not be required for burning, as follows:

1.    Permitted combustibles (dry leaves, dry grass, sticks, branches and small logs) in an amount less than five feet in diameter and two feet in height, more than twenty-five (25) feet from the front lot line, fifteen (15) feet from the side lot line, and ten feet from the rear lot line, provided the fire is watched and controlled and adequate fire protection facilities such as a garden hose or fire extinguisher are available and ready for instant use;

2.    Permitted combustibles in a container having a wire mesh cover with openings of one-half inch or less, which container is more than twenty-five (25) feet from a building, flammable liquids or other materials which create a fire hazard, or in a location approved in writing by the fire chief.

F.    Commercial/Industrial Burning Prohibited. No open burning is allowed at commercial or industrial businesses. Nor shall commercial or industrial businesses be allowed to use burn barrels (or other forms of open burning) to dispose of waste generated by the business.

G.    Exemptions. The following are exempt from the provisions of this section:

1.    Cooking fires in barbecue pits, grills and outdoor fireplaces (barbecues, portable barbecues, outdoor fireplaces, or grills shall not be used for the disposal of rubbish, trash, or combustible waste material);

2.    The operation of home incinerators inside a dwelling, and commercial incinerators.

H.    The mayor and/or the fire chief may suspend all burning or attach additional restrictions to burning when deemed necessary due to atmospheric or other conditions. (Ord. 2318-13 § 4, 2013; prior code § 5.10(9))
