The fees and changes imposed by this chapter may be changed from time to time as set forth in a harbor rates fee schedule established by resolution of the council. Prior to the council approving a resolution under this section the port and harbors director shall cause a copy of the proposed resolution to be posted at the City Hall, the harbor department office and the city’s website at least 14 days prior to the next meeting of the port and harbors advisory board inviting written public comments to be submitted to the director within seven days of such posting. Any such public comments shall then be presented to port and harbors advisory board for its consideration and thereafter presented to the city council before it approves the resolution. This section does not limit written or oral public comments being made to the port and harbors advisory board or the city council at any time. The city council may make amendments to the proposed resolution without providing for additional public comments. (Ord. 1981 § 1, 2023)

14.40.010 Boat length.

For purposes of determining the appropriate moorage facilities reserved moorage fee, boat length shall be that distance measured in a straight line from stem to stern, excluding shear, and shall include bowsprits, pulpits, swim steps, C drives, sterndrive, davits, and any other appurtenances which extend the overall length of the boat. 14.40.020 Mooring facilities reserved moorage fee. Revised 4/24

(a)    Boat owners having applied for and been granted a reserved mooring space shall be required to show proof of ownership and pay in advance semi-annual mooring facilities reserved moorage fees, which fees are charged for the period of April 1st through the last day of September and for the period of October 1st through the last day of March. Payment shall be made in either of the following ways only:

(1)    Payment in full for the period April 1st through September 30th shall be paid in advance by April 1st of each year and payment in full for the period October 1st through the last day of March shall be paid in advance by October 1st; or

(2)    Payment in full for the entire year, April 1st through the last day of March, may be paid in advance by April 1st of each year; provided, however, that the boat owner agrees to also pay, when billed, any increased or additional mooring facilities reserved moorage fees or other fees or charges which are adopted and become effective during that 12-month period. For all boat owners making payments semi-annually the billing period shall be six months.

(b)    Reserved moorage will not be offered or renewed for persons with an outstanding balance due with the city, or an authorized collection agent for the city, for use of the port or harbors.

(c)    Payments for reserved moorage shall only be accepted from the stall holder, their spouse, or a person with a notarized power of attorney for the stall holder.

(d)    The mooring facilities reserved moorage fee applicable to mooring spaces located within Ketchikan and outside of Ketchikan city limits shall be as follows:

(e)    The fee for reserved moorage during the billing period shall be assessed on a pro rata basis or required minimum which is two-thirds of the six-month rate, whichever is greater. Individuals who wish to cancel their reserved moorage shall, upon notification to the harbormaster of their intention, be allowed a refund of the fee paid. This refund shall consist of the full months remaining in the billing period less any minimum as may be required starting at the original assignment of reserved moorage for that particular stall as set forth in subsection (d) of this section, less than any harbor fees owed.

(f)    Boat owners may retain the reserved moorage space assigned to them only so long as they continue to be boat owners. If a boat owner sells or disposes of his boat, he may continue to reserve the space until the end of the reserved moorage period and may not renew same unless he has acquired or given notice of intent to acquire another boat within a reasonable time.

(g)    Boat owners shall file an application for reserved moorage and a moorage application renewal fee as follows. Boat owners who have applied for reserve moorage but are currently on the wait list are eligible to pay reserve moorage rates while using open moorage while on the wait list.

14.40.035 Ryus Float reservation charge.

The reservation fee for use of Ryus Float by lighter vessels shall be as follows:

14.40.040 Other harbor facilities fees.

(a)    Boat owners or operators using the gridiron facilities shall pay as follows per foot of boat length for each 24-hour period, or part thereof, in which the facility is used:

(b)    Solid Waste Fees. In addition to all other fees and charges, all boat owners or operators who are subject to moorage fees under KMC 14.40.020 or 14.40.030 shall pay an additional solid waste fee as follows:

(1)    Daily Moorage. Boat owners or operators subject to the daily moorage facilities use fee under KMC 14.40.030(a) shall pay an additional $0.08 per foot LOA per day.

(2)    Monthly, Quarterly, Semi-Annual Moorage. Boat owners who have been granted reserved moorage under KMC 14.40.020 shall pay an additional $0.19 per month per foot of overall boat length or stall length, whichever is greater; subject to a minimum fee equal to the charge applied to a 20-foot boat. Boat owners or operators who pay moorage facilities use fees on a 30- or 90-day basis under KMC 14.40.030(b) or (c) shall pay an additional $0.19 per foot per month, subject to a minimum fee equal to the charge applied to a 20-foot boat regardless of the overall boat length.

(3)    All solid waste fees shall be due and paid at the time that mooring facilities reserved moorage fees or open moorage facilities use fees are due. Solid waste fees are nonrefundable; provided, however, that upon cancellation of a reserved mooring pursuant to KMC 14.40.020(f) the solid waste fee shall be rebated on the same basis as the reserved moorage fee. The solid waste fee shall be considered a reserved moorage, open moorage, and service fee under KMC 14.40.060 and Chapter 14.50 KMC and all provisions of said sections, including those for late payment charges, liens, impoundment, and loss of reserved moorage, also apply to unpaid or late solid waste fees. The solid waste fee shall be due and paid in full regardless of any interruption, inadequacy, unavailability or loss of solid waste services.

(c)    Additional Solid Waste and Water Fee for Live Aboard Boats. In addition to the fees due under subsection (b) of this section and in addition to all other fees and charges, boat owners or operators of live aboard boats shall pay an additional solid waste and water fee as follows regardless of the size of the boat.

The additional solid waste and water fee shall not be refundable or rebated except under the following circumstances:

(1)    A boat owner who cancels a reserved moorage in the manner set forth in KMC 14.40.020(d) shall receive a partial rebate based upon the number of full months remaining in their current billing period; or

(2)    A boat owner who has a reserved moorage space under KMC 14.40.020 shall receive a refund for each period in which the boat is continuously absent from the boat harbors for a period of one month or more; provided, however, that the owner has notified the harbormaster in advance of each such absence and applies for a refund within two days of the boat’s return to a boat harbor. Notification and application for refund must be in writing on forms approved by the harbormaster. Refunds shall be based upon the number of full months. No refunds shall be made for absences of less than one month.

All additional solid waste and water fees shall be due and paid at the time that mooring facilities reservation fees or open moorage facilities use fees are due. The additional solid waste and water fee shall be considered reserved moorage, open moorage, and service fee under KMC 14.40.060 and 14.50.020 and all provisions of said sections including those for late payment charges, liens, impoundment and loss of reserved moorage apply equally to unpaid or late additional solid waste and water fees. The additional solid waste and water fee shall be due and paid in full regardless of any interruptions, inadequacy, unavailability or loss of solid waste or water services.

(d)    The boat launch ramp fees are as follows:

Upon payment of the permit fee, the harbormaster shall issue a boat launch ramp permit to be attached to the boat owner’s trailer on the driver’s side of the boat trailer winch post or the boat trailer tongue. Upon payment of the permit fee, the harbormaster shall issue a boat launch ramp permit to be attached to the owner’s vehicle/vessel on the driver’s side rear window. Boat owners who have annual reserved moorage at the Ketchikan Boat Harbor shall, upon request, be given annual use permits at no cost for the launching or removal of the boat moored in the harbor. The boat owner shall affix the permit to the boat trailer as provided herein. 14.40.050 Harbormaster service fees.

(a)    Boat launching and pull-out fees and basic charges as provided herein are for one-way only; that is, the charge will be made for either taking a boat out of the water or placing a boat that is on land storage back in the water.

(b)    The harbormaster is granted the power and authority, but with no obligation or duty to do so, and without any obligation or liability on his part or that of the city for his failure to do so, to replace defective mooring lines, pump boats which are in a dangerous condition from lack of pumping, and to move any boat occupying any mooring space for the purpose of protecting such boat from fire or other hazards or for the protection of other boats. Whenever the harbormaster performs any of the acts herein authorized, and after having first attempted to give written or oral notice to the boat owner at the owner’s address as set forth in the moorage application of the immediate need for such action, the owner of said boat is responsible for and shall pay the city the following fees. (d)    The city manager or his designee may establish fees and charges for harbor department services and facilities whenever a fee or charge has not otherwise been established by ordinance. Any such fees or charges may be subject to review and approval of the city council through adoption of the appropriate ordinance. 14.40.060 Payments. Revised 4/24

(a)    All charges herein provided shall be paid to the order of the city of Ketchikan, in advance, at the Municipal Building, 334 Front Street, or the Harbormaster Building at 2933 Tongass Avenue, Ketchikan, Alaska. Payments through the auto pay system will be accepted upon approval by the city finance department.

(b)    Any boat owner or operator who fails to pay the moorage and service fees as herein provided, at the time and place when such fees are due and payable, and for a period of 30 days thereafter, shall be subject to an action by the city for the recovery of such fees and charges.

(c)    The harbormaster may, pursuant to the procedure provided for in KMC 14.50.020, impound any boat in the boat harbor for which the applicable fees or charges set forth in this chapter remain unpaid for more than 30 days after such fees or charges become due.

(d)    The city shall have a lien for any unpaid mooring reservation fees (excepting fees created by KMC 14.40.020(e), mooring facilities use fees, other harbor facilities fees, and harbormaster service fees under 46 U.S.C. Section 971. Should any such fees be unpaid or unsecured for 30 days after due, the city may file a complaint in rem in the federal district court in the district in which the boat may be found. If it appears that such boat will leave the federal district in which the city is located, the complaint in rem may be filed prior to the expiration of the 30-day period.

The city reserves its rights to pursue any applicable lien created by state statute including, specifically, AS 34.35.175 and 34.35.220, or any amendments thereto.

All liens created shall not be exclusive remedies. A proceeding to foreclose any lien or suit thereon by the city shall not preclude any other remedy, including impoundment as above, at law or in equity. The procedure for foreclosure or suit thereon of any lien shall be as set out in applicable state or federal law.

(e)    If the mooring facilities reserved moorage fee or any other harbor fee remains unpaid for a period of 25 days after the billing date, the city may send by first class mail, or personal service, to the holder of the reserved mooring space written notice of the failure to pay the reserved moorage fee. Said notice shall state that if the fee is not paid within 10 days of receipt of the notice, any right or interest of the holder of the reserved mooring space to use or occupancy of the mooring space terminates, and the city is entitled to immediate use and occupancy of said mooring space.

(f)    Charges for reserved moorage which are not paid within 25 days after the billing date are delinquent. In addition to interest a late payment fee of $20.00 shall be added to all delinquent reserved moorage charges and shall be immediately due. Charges for open moorage and/or other harbor services billed by the city which are not paid within 30 days after the billing date are delinquent. Interest at the rate of 0.875 percent per month shall be assessed against all delinquent amounts and shall be immediately due and shall continue to be assessed until all delinquent amounts are paid in full.

(g)    Prior to issuance of a one-month permit, or granting of reserved moorage, all delinquent balances on any port and harbors account for any currently owned or previously owned boat must be paid in full or have an established repayment schedule approved by the port and harbors department. One-month permits and reserved moorage may be rescinded if timely payments are not received in accordance with an approved payment schedule.
