2.35.010 Department of Health and Human Needs established.

There shall be a department in and for the City known as the Department of Health and Human Needs. It shall consist of the Village Public Safety Officer(s) and as many other officers and firefighters as may be deemed necessary for the effective operation of the Department. [Ord. 04-82-01 § 1].

2.35.020 Saxman Volunteer Firefighters Association.

(a) Organization. Members of the Department of Health and Human Needs may organize into a volunteer association with the election of their officers and bylaws.

(b) Powers. The function and duties of the officers of the Volunteer Firefighters Association shall not interfere with those of regular Department officers who are charged with responsibility for all fire, emergency, harbor patrol and law enforcement activities of the Department.

(c) Funding by the City. From time to time in such amounts as the City Council deems advisable, payments may be made to the Volunteer Firefighters Association for the purpose of giving that association funds with which to reimburse members for clothing damaged while fires and for such other purposes in keeping with its functions. 2.35.030 Village Public Safety Officer.

(a) Appointment. The Village Public Safety Officer shall be appointed by the Mayor subject to confirmation of the City Council, and shall be responsible to the City Manager or his designee. His or her appointment shall be for an indefinite period of time and with tenure of office, depending upon his or her good conduct and efficiency. He or she shall be technically qualified through training and experience and shall have the ability to command personnel. He or she shall be removed only for just cause based upon personnel policies and procedures adopted by the City Council.

(b) Powers and Duties. The Village Public Safety Officer shall:

(1) Develop and recommend to the City Manager and the City Council policies and procedures pertaining to the enforcement of rules and regulations for the administration and operation of the Department of Health and Human Needs.

(2) Preserve the public peace and order in the prevention and detection of crime, and apprehension of offenders, the protection of persons and of property and the enforcement of the law.

(3) Operate the City Jail and/or coordinate with Alaska State Troopers on the incarceration of suspects at other facilities.

(4) Enforce all traffic, fire safety, boat harbor and animal control ordinances of the City and State laws pertaining thereto.

(5) Construct, maintain and repair all fire alarm facilities.

(6) Inspect business and other premises for fire hazards, conduct educational fire prevention programs and first aid courses in cooperation and coordination with the Saxman Volunteer Firefighters Association and explain the criminal justice system to interested persons.

(7) Render emergency services for which his or her Department is trained and equipped.

(8) Perform such other duties as may be required by the City Manager or City Council or as prescribed by this code. [Ord. 04-82-01 § 3].

2.35.040 Rules and regulations.

The Village Public Safety Officer shall develop in coordination with the Saxman community, maintain, enforce and update a comprehensive set of policies and procedures governing the discipline, training and operation of the Department of Health and Human Needs. Such policies, procedures and any deletions, changes or additions shall be effective when approved and filed with the City Council. The Village Public Safety Officer shall strictly enforce and carry out those policies and procedures and is authorized to suspend or remove from service any officer or firefighter as provided in the policies and procedures. 2.35.050 Training and records.

(a) The Village Public Safety Officer shall, at least two times per month, provide for suitable drills covering the operation and handling of all equipment essential for efficient Department operation. In addition, he or she shall provide at least four times a year quarterly sessions of instruction to include such subjects as first aid, fire prevention and suppression, boating, swimming and hunting safety, drug and alcoholic beverages abuse, and law enforcement procedures and systems.

(b) The Village Public Safety Officer shall maintain a record of such training as well as maintain a listing of all trained members and officers of the Department which shall at all times be kept current along with his or her regular recordkeeping duties. [Ord. 04-82-01 § 5].

2.35.060 Equipment – City-owned.

(a) The Village Public Safety Officer shall be responsible to the Manager and City Council for recommending such apparatus or other firefighting, emergency medical or law enforcement equipment as may be required to maintain Department efficiency, for providing suitable arrangements and equipment for reporting fires or emergencies and for notifying all members of the Department/Volunteer Firefighters Association to assure a prompt response to such incidents.

(b) No person shall use any fire apparatus or equipment for any private purpose, nor shall any person willfully and without proper authority take away or conceal any article used in any way by the Department.

(c) No person shall enter any place where fire apparatus or equipment is housed or handle apparatus or equipment belonging to the Department unless accompanied by or having special permission of an officer or authorized member of the Department. [Ord. 04-82-01 § 6].
