1-21-1 PURPOSE:

There is hereby created a Building Safety Advisory and Appeals Board consisting of five (5) members to hear and decide appeals of orders, decisions or determinations made by the Chief Building Official in the application and interpretation of the City of Prescott Building, Electrical, Mechanical, and Plumbing Codes. 1-21-2 JURISDICTION AND BOARD PROCEDURES:

(A) The Board shall receive appeals from any person, firm, corporation or political subdivision to determine the suitability of alternate materials or methods of construction and to provide reasonable interpretations of the Code. Also to review any decision rendered by the Building Official when there has been an appeal presented.

(B) All applications to the Board shall be presented in writing with sufficient information, data and applicable documents for the Board to render a decision.

(C) The Board shall render all decisions and findings in writing with a duplicate copy to the appellant.

(D) The Board shall meet upon notice of the Building Official within thirty (30) calendar days of the filing of an appeal.

(E) All Board hearings shall be held pursuant to Arizona Open Meetings Law. The appellant, his representative and any other person whose interest may be affected by the matter on appeal shall be given an opportunity to be heard and notice of said hearing shall be given to the appellant at least ten (10) business days before said hearing is to take place. 1-21-3 BOARD APPOINTMENTS AND MEMBERSHIP REQUIREMENTS:

(A) The Board shall consist of five (5) voting members appointed by the City Council for staggered four (4) year terms so that no more than two (2) terms expire in a given year. The City of Prescott Council shall fill vacancies for unexpired terms. The City Council shall be the sole arbiter of the qualifications of Board members.

(B) Members of the Board shall include persons with the following qualifications:

1. One (1) architect or a professional engineer currently or prior licensed in the state of Arizona, held in good standing, who is at the time of appointment and during his or her term a resident of the City of Prescott.

2. One (1) general contractor, currently or prior licensed, held in good standing, who is at the time of appointment and during his or her term a resident of the City of Prescott.

3. Up to two (2) persons who, at the time of appointment and during their respective terms, are residents of the City of Prescott, with knowledge relating to building and construction trades.

4. Up to two (2) persons currently or prior licensed in good standing, or possessing knowledge in the electrical, mechanical, or plumbing trades, who, at the time of appointment and during their respective terms, are residents of the City of Prescott.

5. The Chief Building Official shall be an ex officio member, shall have no vote upon any matters before the Board, and shall act as or provide a secretary to the Board who shall maintain detailed records of all proceedings on file, perform other secretarial duties as required by the Board and who shall have no vote upon any matters before the Board.

(C) The City Council shall appoint a chair and vice-chair of the Board from among the Board’s membership. (Ord. 2018-1637, 12-11-2018)
