SMOKING IN HAZARDOUS OUTDOOR AREAS

8.12.010 Smoking in areas with inflammable vegetation prohibited.

It is unlawful for any person, while traveling on foot, bicycle, motorcycle, open automobile, truck or other vehicle, or any domestic animal, in grain, grass, stubble, brush, timber or other inflammable vegetable cover or material, on roads and/or trails and/or in other areas posted against smoking, to smoke. (Ord. 215 § 1, 1960)

8.12.020 Exceptions—Procedure for extinguishing fires.

Notwithstanding the provisions of Section 8.12.010 of this chapter, it shall be lawful for a person to smoke in an improved campground, inside a vehicle on a road, at a place of habitation, and while stopped in a cleared or barren area not less than three feet in diameter, provided that such person shall, before discarding any smoking material or substance, completely extinguish such material or substance so that the same shall not thereafter burn or glow or occasion any fire. 8.12.030 Enforcement authority.

The State Forester of the state of California and his duly authorized agents, and all United States Division of Forestry officers and their duly authorized agents are hereby declared to be peace officers of Alpine County for the purpose of and with the right to enforce all of the provisions of this chapter. (Ord. 215 § 4, 1960)

8.12.040 Violation—Penalty.

Each violation of this chapter shall constitute a misdemeanor punishable by imprisonment in the County Jail for a maximum of six months, or by a maximum fine of three hundred dollars, or by both such fine and imprisonment. (Ord. 215 § 3, 1960).
