17.90.010 Purpose.

This chapter applies to proposals for amendments to the text of this title and to proposals for changes to the zoning map adopted pursuant to Section 17.12.020. (Ord. 510 §9, 2021; Ord. 323 §53(part), 1992)

17.90.020 Initiations/application.

An amendment or zone change may be initiated by either of the following:

A.    The owner, or agent authorized by the owner, shall apply for a code amendment, rezoning or general plan amendment on a form prescribed by the city planner. The application shall be submitted to the community development department accompanied by a fee established by the city council. Accompanying submittals shall include such plans, studies, and other information as determined necessary by the city planner to evaluate the proposal based on the nature and location of the project.

B.    Resolution of intention of the city council or planning commission. (Ord. 510 §9, 2021; Ord. 323 §53(part), 1992)

17.90.030 Processing.

A.    Notification. At least ten days prior to the public hearing to consider a code amendment, rezoning or general plan amendment, the city planner shall notify adjacent landowners describing the nature and location of the proposal and soliciting input. Notification will be via mail or email to landowners within a minimum of three hundred feet from the proposed project.

B.    Review. The city planner shall review the application, as applicable and foreseeable, for conformance with adopted codes, standards, plans, availability of public services and utilities, fire protection, access, traffic circulation, and potential environmental impacts. The city planner shall report his or her findings to the planning commission for consideration pursuant to subsection C of this section.

C.    Public Hearing--Recommendation of the Planning Commission. The planning commission shall hold a duly noticed public hearing to consider proposed code changes, general plan amendments or zone changes. Upon conclusion of the hearing, the commission shall either recommend to the city council approval of the proposed change or denial of the requested change. Decisions shall be made upon findings of fact as established in Section 17.90.040. A recommendation of the planning commission and supporting findings shall be provided to the city council in writing within thirty days.

D.    Public Hearing--City Council. The city council upon receipt of the commission’s recommendations shall hold a duly noticed public hearing. Said hearing and the notice thereto shall be in compliance with California Government Code Sections 65090 through 65096 as applicable. The city council shall make findings of fact pursuant to Section 17.90.040. All zoning changes or amendments must be adopted by ordinance. Any general plan amendments which are brought about by changes or amendments to zoning may be adopted by resolution or ordinance. (Ord. 510 §9, 2021; Ord. 323 §53(part), 1992. 17.90.040 Findings.

Prior to recommending or approving a general plan amendment, rezoning or code change, as applicable, the planning commission and the city council shall make all the following findings:

A.    The proposed change or amendment is consistent with the city of Angels Municipal Code; and

B.    The proposed change or amendment is consistent with the city of Angels general plan; and

C.    The proposed change or amendment will not be substantially detrimental to the health, safety, or general welfare of the city. (Ord. 510 §9, 2021)

17.90.050 Enactment.

Ordinances approving changes to the zoning code, the zoning map and the general plan become effective thirty days after their adoption unless urgency provisions apply. Resolutions amending the general plan become effective thirty days after adoption unless adopted as an urgency ordinance. Within thirty days of the effective date of a zone change or amendment to this title, the city planner shall cause said amendments or changes to be reflected on the official city general plan land use and zoning map and all copies of any zoning maps to be distributed by the city. Within thirty days the city planner shall also notify the Calaveras County assessor’s office of the zoning change. Within thirty days of the effective date of a zone change or amendment, or as soon thereafter as practicable, but no later than six months, the city clerk shall cause any amendments or additions to the text of this title to be clearly reflected within the official city codes and on all copies of this title to be subsequently distributed by the city.
