10.20.010 Findings.

Pursuant to the report of the city’s traffic engineer presented to the city council on August 12, 1991, and public testimony heard at a regular meeting of the city council on that date, the city council finds that stopping, parking or standing of vehicles on Calimesa Boulevard between Sandalwood Drive and Myrtlewood Drive creates a hazardous condition by impairing the visibility of vehicles entering and exiting driveways along Calimesa Boulevard. 10.20.020 Stopping, parking or standing of vehicles prohibited.

Pursuant to California Vehicle Code Section 22507, which provides that local authorities may prohibit the stopping, parking or standing of vehicles on certain streets and highways during all hours of the day, all parking, stopping or standing of vehicles is prohibited in the following locations:

A. On the easterly side of Calimesa Boulevard between Sandalwood Drive and Myrtlewood Drive.

B. On the westerly side of Calimesa Boulevard from Sandalwood Drive to a point 100 feet northerly of the northeast corner of Riverside County assessor’s parcel No. 411-210-021.

C. On the northerly side of Avenue L from Calimesa Boulevard to a point 450 feet easterly of Calimesa Boulevard.

D. On the easterly side of Calimesa Boulevard from Avenue L north 35 feet.

E. On the southwesterly side of Desert Lawn Drive from the entrance to The Plantation Mobile

Home Park to a point 500 feet in a northwesterly direction and up to 1,900 feet in a southeasterly direction.

F. At all U.S. Postal Service collection boxes located for curbside use, 20 feet in each direction from the box; except for vehicles while depositing mail, or Postal Service personnel while collecting mail.

G. Along the southeast and southwest curb returns at Second Place and Fairway Lane including the south side of Second Place up to 13 feet east of Fairway Lane curb return and 39 feet west of Fairway Lane curb return. 10.20.030 Violations.

Pursuant to California Vehicle Code Section 40000.1, it is unlawful and constitutes an infraction for any person to violate or fail to comply with any provision of this chapter. [Ord. 91-25; Code 1990 § 3.1.03.]

10.20.040 Penalties.

Pursuant to California Vehicle Code Section 42001, every person convicted of an infraction for a violation of this chapter shall be punished as follows:

A. By a fine of $100.00;

B. For a second infraction occurring within one year of a prior infraction which resulted in a conviction, a fine of $200.00;

C. For a third infraction occurring within one year of two prior infractions which resulted in convictions, a fine of $250.00. [Ord. 91-25; Code 1990 § 3.1.04.]

10.20.050 Misdemeanor – Three or more violations.

Pursuant to California Vehicle Code Section 40000.28, any offense which would otherwise be an infraction is a misdemeanor if a defendant has been convicted of three or more violations of this chapter within the 12-month period immediately preceding the commission of the offense and such prior convictions are admitted by the defendant or alleged in the accusatory pleading. For this purpose, a bail forfeiture shall be deemed to be a conviction of the offense charged. [Ord. 91-25; Code 1990 § 3.1.05.]

10.20.060 Penalties for misdemeanors.

Pursuant to California Vehicle Code Section 42002, every person convicted of a misdemeanor for a violation of any of the provisions of this chapter shall be punished by a fine of $1,000 or by imprisonment in the county jail for a period not exceeding six months, or by both such fine and imprisonment. 10.20.070 Time when this chapter applies.

Pursuant to California Vehicle Code Section 22507, the provisions of this chapter shall apply when the curbs in the areas described in CMC 10.20.020(A) and (B) have been painted red as required by California Vehicle Code Section 21458 and the appropriate signs have been installed in accordance with the standards adopted by the California Department of Transportation.
