10.56.010 Unlawful acts.

A. No person shall operate or use a bicycle on any street or other public property in the City which has not been licensed as provided in this chapter or has not been licensed by any other city or county in the State.

B. It is unlawful for any person to tamper with, destroy, mutilate, or alter any license indicia or registration form, or remove, alter, or mutilate any serial number, or the identifying marks of a licensing agency’s identifying symbol, on any bicycle frame licensed under State law. (Ord. 374 § 1, 1981; prior code § 15.14-3(a, b)).

10.56.020 Registration – Forms.

The Chief of Police shall obtain the bicycle license indicia and registration forms authorized by California Vehicle Code Section 39001. (Ord. 374 § 1, 1981; prior code § 15.14-2).

10.56.030 Registration – Application.

Every person desiring a bicycle license plate in the City shall make application to the Police Department upon the approved registration form and shall pay the required fees. After completing the registration form and issuing the license plate(s), the Police Department shall furnish to the applicant a duplicate of the approved registration form. (Ord. 374 § 1, 1981; prior code § 15.14-4).

10.56.040 License – Fee.

The license fee shall be $2.00 for each calendar year or portion thereof for a new license plate. Three-year licenses may be issued on request, and $1.00 per year or any portion thereof for a transfer, replacement or renewal of a bicycle license. (Ord. 374 § 1, 1981; prior code § 15.14-5).

10.56.050 License – Issuance.

Upon approval of the application, and payment of the license fee, the Police Department shall issue bicycle license indicia and a registration card which shall be effective until December 31st of the second year following the year of application. (Ord. 374 § 1, 1981; prior code § 15.14-6).

10.56.060 License – Expiration.

The bicycle license shall expire on the thirty-first day of December of the second year following the year of application. (Ord. 374 § 1, 1981; prior code § 15.14-7).

10.56.070 License – Renewal.

Application for renewal of a bicycle license shall be made by the owner, prior to expiration of the existing license, and shall be made by presentation of the owner’s copy of the registration form last issued for the bicycle and by the payment of the next licensing fee for the bicycle as provided in this chapter. Pursuant to CMC 10.56.050, the applicant may renew for a period of three years by the payment of three years’ licensing fee. (Ord. 374 § 1, 1981; prior code § 15.14-8).

10.56.080 Records of registration.

The Police Department shall maintain records of each bicycle registered. Such records shall include, but not be limited to, the license number, the serial number of the bicycle, the make and type of bicycle, and the name and address of the licensee. Such records shall be maintained during the period of validity of the license or until notification that the bicycle is no longer to be operated. (Ord. 374 § 1, 1981; prior code § 15.14-11).

10.56.090 Information required upon retail sale.

A. Each local bicycle retailer and each local bicycle dealer shall supply to each purchaser a preregistration form provided by the Police Department and shall include, on the sales check or receipt given to the purchaser, a record of the following information: name of retailer, address of retailer, year and make of the bicycle, serial number of the bicycle if delivered to the purchaser in an assembled state, general description of the bicycle, name of purchaser, and address of purchaser. A copy of the preregistration form shall be filled out and forwarded by the purchaser to the Police Department within 10 days from date of sale.

B. “Bicycle dealer” is any person who sells, gives away, buys or takes in trade for the purpose of resale, more than five bicycles in one calendar year, whether or not such bicycles are owned by such person. “Bicycle dealer” also includes agents or employees of such person. 10.56.100 Recordation of transfer.

A. Whenever any person sells or otherwise disposes of a bicycle, the person shall endorse upon the registration certificate previously issued for such bicycle a written transfer of same, setting forth the name, address, telephone number of the transferee, date of transfer and signature of the transferor, and shall deliver the registration certificate, so endorsed, to the Police Department within 10 days. The Police Department shall maintain records of such sales or transfers.

B. Any person who purchases or otherwise acquires possession of a bicycle shall, within 10 days of taking possession, apply for the transfer of license to the new owner’s name. (Ord. 374 § 1, 1981; prior code § 15.14-13).

10.56.110 Notification of change of address.

Whenever the owner of a bicycle licensed pursuant to this chapter has a change of address, the owner shall within 10 days of such change notify the Police Department of the old and new addresses.

10.56.120 Lost license plate or lost registration form.

If any license indicia or registration form issued pursuant to the provisions of this chapter is lost, stolen, or mutilated, the licensee of such bicycle shall immediately notify the Chief of Police and, within 10 days after such notification, apply to the Police Department for duplicate license indicia or registration form. The Police Department shall issue to such licensee replacement indicia or registration form upon payment of the appropriate fee.

10.56.130 Impoundment.

The Police Department shall have the right to impound and retain possession of any bicycle in violation of the provisions of this chapter, and may retain possession of such bicycle until the provisions of this chapter are complied with. (Ord. 374 § 1, 1981; prior code § 15.14-3(d)).

10.56.140 Riding on sidewalks.

A. It is unlawful for any person to ride or operate a bicycle on any sidewalk in the City.

B. Where this chapter has been violated by persons under the age of 16 years, in lieu of such fines as provided in this chapter, the person sitting as the Traffic Hearing Officer of Juvenile Traffic Court may prohibit the operation of a bicycle by the person upon the streets and public places in the City, for a period not to exceed 30 days. If said juvenile owns or controls a bicycle, the officer may order the bicycle to be impounded at the Police Department for the period so specified by the court. At the expiration of the specified impoundment, the bicycle will be returned to the owner upon request. (Ord. 374 § 1, 1981; prior code § 15.14-14).

10.56.150 Operation of electric carts on public sidewalks.

A. Pursuant to authorization of California Vehicle Code Section 21114.5, physically disabled persons, or persons 50 years of age or older, may operate electric carts on the public sidewalks within the City, subject to prior compliance with subsection (B) of this section.

B. Any disabled person or person 50 years of age or older who owns, leases or operates an electric cart shall, prior to operating same on any public sidewalk of the City, apply to the Police Department for a permit and an identification sticker to so operate said electric cart. The person receiving such sticker shall affix such sticker to the electric cart prior to operating the same on public sidewalks of the City. (Ord. 374 § 1, 1981; prior code § 15.14-15).

10.56.160 Operation of skateboards on public sidewalks.

A. It is unlawful for any person to operate or ride a skateboard, or rollerblades or rollerskates on any nonresidential sidewalk of the City or within the area bounded by and including Lincoln Avenue on the east, Second Street on the west, Foothill Boulevard on the south, and Fair Way on the north.

B. “Skateboard” shall mean any multiwheeled device which is utilized to transport one or more persons thereon and is propelled or pushed by the operator(s) human power or by gravitational force or by ancillary motors or engine and includes scooters. “Skateboard” does not include bicycles.

C. Upon a second conviction, the Police Department may impound the skateboard for a period not exceeding 30 days. (Ord. 374 § 1, 1981; prior code § 15.14-16).

10.56.170 Skating safety equipment.

Any person riding a skateboard, roller skates or similar devices at a recreational skateboard facility owned by the City shall wear a helmet, elbow pads, and kneepads while engaged in such activity. (Ord. 575 § 1, 2001).
