CLEANING OF PROPERTY AND STREETS

12.12.010 Removal of trees, plants or other refuse material by owner required.

It is the duty of every owner, occupant, agent, claimant or person having charge, possession or control of any real property within the corporate limits of the City to:

A. Remove and clear away at such person’s own expense the weeds, rank grass and brush from the sidewalk and to the center of the street in front of said real property fronting upon a public street to a height of not less than seven feet above the ground thereunder;

B. Remove any trees which by reason of disease or otherwise have become or are dangerous or hazardous to those using the public streets or sidewalks;

C. Take up and destroy all noxious plants growing upon said real property before said plants put forth blooms;

D. Mow, destroy, and remove all other rank grass or growths of noxious weeds thereon; and

E. Remove from such real property any garbage or refuse material detrimental to the public health or in danger of becoming a fire hazard. (Ord. 299 § 1, 1973).

12.12.020 Duty of Director of Public Works to notify owner.

It is the duty of the Director of Public Works to notify any person failing to comply with the provisions of CMC 12.12.010 to comply therewith by written notice served in the manner provided in CMC 12.12.030.

12.12.030 Service of notice for removal.

A. Such notice shall be given by certified mail to the owner or owners of record as shown on the current assessment roll of property in the County.

B. Personal service of a notice similar in substance upon the owner, occupant or agent in charge of such property shall be equivalent to notice by certified mail. (Ord. 300 § 1, 1973).

12.12.040 Appeal.

Within 10 days of the receipt of such notice by the property owner, occupant, or agent in charge of such property, either by certified mail or personal service, such person may appeal by filing a written notice of appeal with the City Clerk.

At the next regular meeting of the Council it shall proceed to hear and pass upon such appeal, and its decision thereof shall be final and conclusive. (Ord. 300 § 1, 1973).

12.12.050 Conditions for removal by City.

A. Unless within 10 days from the date of receipt of said notice provided for in CMC 12.12.030, or in the case of appeal to the Council, within 10 days from the date of determination thereof unless the same is sustained, the weeds, grass, brush, growths, branches of trees, and refuse, as the case may be, are removed from said property as directed by said notice or by the Council on appeal, the materials shall be considered a public nuisance.

B. If upon appeal the requirements of the original notice are modified, the Director of Public Works in removing or causing to be removed such weeds, grass, brush, growths, branches of trees, garbage or refuse, shall be governed by the determination of the Council. (Ord. 300 § 1, 1973).

12.12.060 Dumping of weeds or rubbish in public places prohibited.

No person shall place, dump, burn or otherwise dispose of any grass, plants, leaves, brush, weeds, trash or rubbish in or upon any public street, sidewalk, drain, drainage ditch, or other property or right-of-way of the City. (Ord. 279 § 1, 1971).
