10.48.010 Use on Certain Streets.

Tour buses shall use only the following streets, in a north-south direction only, for ingress and egress of the City:

A. Carpenter Street between the northerly City limit and Second Avenue;

B. Second Avenue between Carpenter Street and Santa Fe Street;

C. Santa Fe Street between Second and Third Avenues;

D. Third Avenue between Santa Fe Street and Junipero Avenue;

E. Junipero Avenue between Third Avenue and Eighth Avenue;

F. Eighth Avenue between Junipero Avenue and San Carlos Street;

G. San Carlos Street between Eighth Avenue and Thirteenth Avenue;

H. Thirteenth Avenue between San Carlos Street and Rio Road; and

I. Rio Road between Thirteenth Avenue and the southerly City limit. (Ord. 78-16 § 1, 1978; Ord. 77-15 § 2, 1977; Code 1975 § 538.3(a)).

10.48.020 Use in Residential Districts.

Tour buses shall be prohibited from using any streets in the residential district except those described in CMC 10.48.010 with the following exceptions:

A. Emergencies;

B. For the purpose of loading and unloading passengers at hotels and motels where the passengers are to stay overnight in the City, tour buses shall be allowed to use the most direct streets between the commercial district and the lodging place of the passengers;

C. Transporting passengers to or from specific restaurants within the City where arrangements for dining have been made in advance of arrival;

D. Transporting passengers to or from specific cultural or entertainment events within the City; and

E. Transporting local persons from and back to the City for any purpose. (Ord. 77-15 § 2, 1977; Code 1975 § 538.3(b)).

10.48.030 Use in Commercial Districts.

Tour buses shall be prohibited from using any streets within the commercial district except those described in CMC 10.48.010, with the exceptions stated in CMC 10.48.020. (Ord. 77-15 § 2, 1977; Code 1975 § 538.3(c)).

10.48.040 Parking, Stopping or Standing.

A. It is unlawful for tour buses to park, stop or stand (except when necessary to avoid conflict with other traffic or in compliance with the directions of a peace officer or official traffic-control device) anywhere in the City other than in the following areas:

1. The west side of Junipero Avenue between Ocean and Seventh Avenues; subject to subsection (C) of this section;

2. Where necessary in connection with the exceptions stated in CMC 10.48.020;

3. Such areas as may hereafter be designated by an ordinance or resolution of the City Council.

B. Tour buses may park, stop, or stand in the residential district no longer than 20 minutes solely for the purpose of loading or unloading overnight lodging passengers, with the exception that there shall be no time limitation on tour buses parking, stopping or standing entirely on private property belonging to lodging places where passengers stay overnight.

C. In accordance to the provisions of CMC 10.32.080(N), tour buses may park, stop, or stand in the designated loading and unloading areas on the west side of Junipero Avenue between Ocean Avenue and Seventh Avenue and when necessary in connection with the exceptions stated in CMC 10.48.020.

D. The tour bus owner, representative of the owner, or person operating the bus shall be required to pay a fee for parking in a designated tour bus parking stall, said fee to be established by the City Administrator or her/his designee.

E. Tour buses shall be allowed to stop or stand on the public parking lots at Sunset Center and tour buses transporting passengers to the Carmel Mission shall be allowed to stop or stand on the public parking lot at the Carmel Mission, in each case solely for the purpose of loading or unloading passengers to or from specific cultural or entertainment events at Sunset Center or the Carmel Mission. 10.48.050 Implementation.

Copies of City Ordinance 77-14 and any amendments to it, including the ordinance codified in this section, shall be sent by the City Clerk to the California Public Utilities Commission and each tour bus company known by the City to operate within the City. The first time a tour bus is found operating in violation of Ordinance 77-14, or any amendment to it, the driver shall be given a warning consisting of a copy of Ordinance 77-14 and amendments thereto, and a written request that the ordinance and amendments be delivered to the management of the company operating the bus. The name of the bus driver, the name of the company operating the bus, and the license number of the bus shall be indexed for quick reference by the Police Department. Upon stopping a tour bus suspected of violating Ordinance 77-14, or amendments thereto, and establishing that a warning was previously issued to the company, and that a violation exists, a citation shall be issued citing the company operating the bus for violation of Ordinance 77-14, or amendments thereto, and, if the driver has previously received a warning s/he shall receive a separate citation. 10.48.060 Signs.

The Director of Public Works is directed to place appropriate signs along the route designated for tour bus use at locations which will give reasonable notice of the tour bus route. (Ord. 77-17 § 2, 1977; Code 1975 § 538.3(f)).
