2900 Adoption of Personnel System.

In order to establish an equitable and uniform procedure for dealing with personnel matters; to attract to municipal service the best and most competent persons available; to assure that appointments and promotions of employees will be based on merit and fitness; and to provide a reasonable degree of security for qualified employees, the following personnel system is hereby established. 2901 Appointing Authority.

The City Manager shall be the appointing authority for all positions in the City Service except elective officers and those appointed by the City Council. The City Manager may delegate the appointing authority to the extent authorized by the City Council. (Ord. 77-406, § 2; Ord. 81-565, § 1; Ord. 98-1152U, § 1; Ord. 98-1152, § 1)

2902 Repealed.

2903 Competitive Services.

The provisions of this Chapter shall apply to all offices, positions and employments in the service of the City except:

(a) Elective officers;

(b) Individuals serving on boards, commissions, committees and agencies;

(c) Individuals performing services under contract;

(d) City Attorney;

(e) Individuals performing services during a declared emergency;

(f) Individuals appointed to part-time or seasonal employment;

(g) City Manager and Assistant City Manager;

(h) Administrative Services General Manager, Development Services General Manager, Economic Development General Manager, Public Services General Manager, Director of Finance, Director of Human Resources, Director of Parks and Recreation, Director of Public Safety, Director of Public Works, and Council Field Representative;

(i) All volunteer personnel; and

2904 Adoption and Amendment of Rules.

Personnel Rules shall be adopted by resolution of the City Council after notice of such action has been publicly posted at least five (5) days prior to City Council consideration. Amendments and revisions may be suggested by an interested party and shall be processed as provided in the Personnel Rules. The Rules shall establish regulations governing the personnel system.

The Personnel Rules shall not apply to the positions listed in CMC 2903, except as specifically made applicable by a memorandum of understanding or Resolution of the City Council.

(a) Annual Vacation Leave provided for in Rule X, Section 3;

(b) Sick Leave provided for in Rule X, Section 4;

(c) Disability Compensation provided for in Rule X, Section 5;

(d) Emergency Leave provided for in Rule X, Section 6;

(e) Military Leave provided for in Rule X, Section 7;

(f) Leave of Absence (without pay) provided for in Rule X, Section 8;

(g) Jury Duty provided for in Rule X, Section 9;

2905 Appointments.

Appointments, demotions, dismissals, reductions in pay, suspensions or other actions regarding an employee shall be made in accordance with the Personnel Rules except as to those persons listed in CMC 2903. The Assistant City Manager and persons holding those positions listed in CMC 2903(h) shall serve the City at the pleasure of the City Manager and such persons may be discharged, demoted or otherwise disciplined without notice, hearing or stated cause.
