REGULATIONS APPLICABLE TO THE SALE AND USE OF AEROSOL PAINT CANS, DYE CONTAINERS, MARKING PENS AND CERTAIN TOOLS OR INSTRUMENTS

9.70.010 Sale of aerosol paint cans, dye containers, and certain marking pens and tools or instruments.

It shall be unlawful for any person to sell, exchange, give, or loan, or cause or permit to be sold, exchanged, given, or loaned, any pressurized can or other container commonly known as an aerosol paint can, dye, or similar container, or any marker with a tip larger than one-quarter inch and tool or instrument designed to inscribe on glass or metal to anyone under the age of eighteen years, unless such juvenile is in the presence of his or her parent or guardian, or as part of a school district art or similar class assignment. It shall be unlawful for anyone under the age of eighteen years to purchase or otherwise obtain any aerosol paint can, dye container, markers with a tip larger than one-quarter inch and tools or instruments designed to inscribe on glass or metal unless such juvenile is in the presence of his or her parent or guardian, or as part of a school district art or similar class assignment. 9.70.020 Display of aerosol paint cans, dye containers and certain marking pens and tools or instruments.

(a) Any business or establishment offering for sale to the public any paint or dye packaged in an aerosol paint can, dye container, markers with a tip larger than one-quarter inch and tools or instruments designed to inscribe on glass or metal shall keep, store and maintain such aerosol paint cans, dye containers, markers and inscribers in a place that is locked and secured, or otherwise inaccessible to the public.

(b) Any business or establishment offering for sale to the public any aerosol paint can, dye containers, markers and inscribers shall post and maintain a sign which contains the provisions of Cerritos Municipal Code Section 9.70.010 in letters at least one-half inch in height. Such a sign shall be plainly visible to customers who may seek to purchase aerosol paint cans, dye containers, any marker with a tip larger than one-quarter inch in width, and tools and instruments designed to inscribe in glass or metal. 9.70.030 Possession prohibited by minors.

No person under eighteen years of age may have in their possession any aerosol paint can, dye container, marker with a tip larger than one-quarter inch in width or any tools or instruments designed to inscribe or etch on glass or metal on any public highway, street, alley, or way, or in any automobile, vehicle or other conveyance unless that person is accompanied by a parent or guardian.
