28.80.010 Purpose.

All regulations and procedures set forth in this chapter are for the purpose of controlling and eliminating public nuisances or safety hazards associated with unsafe or unsightly conditions which may result from the demolition and/or removal of all buildings or structures on any parcel of land in the city. 28.80.100 General provisions.

No person, firm or corporation shall remove or demolish any building or structure, or any section of any building or structure, except a contractor’s toolhouse, construction building or similar structure which is moved as construction requires, unless the following requirements are met:

The owner of the property on which the structure to be moved or demolished is located or the owner’s agent shall:

(1) Complete the application for a demolition permit as provided by Section 28.80.200;

(2) Pay the appropriate fees and post the required bonds as specified in Section 28.80.200;

(3) Subsequent to the approval of the application for a demolition permit, the following shall be obtained from the building and safety division:

(A) A building permit for the purpose of demolition, removal and/or disposition of any structures,

(B) A sewer disconnection permit for the capping of any sewer or backfilling of any septic tank or cesspool;

(4) Obtain a well destruction permit from the city water department and the county in order to cap off any existing water wells on the property;

(5) Provide information relative to the location of the site proposed for the dumping of debris removed from the subject parcel;

(6) Be responsible for the complete removal and disposition, including but not limited to all structures, concrete foundations, boards, fences, walls, wire and poles, rubbish and plant material damaged or destroyed regardless of size, shape or weight. The demolition shall be completed in such a manner to render the parcel back to its original vacant state;

(7) Apply to the property the appropriate weed killer and/or dust retardant as required by the director of community development;

(8) Install and maintain a six-foot high chain link fence around all or such portion of the property as is determined by the director of community development. (Ord. 770 § 1 (part), 1996; Ord. 471 § 2 (part), 1974)

28.80.200 Applications.

Applications for a demolition permit shall be filed with the director of community development and shall contain the following:

(1) A statement signed by the owner of the property setting forth his full name and address and the type and location of the building or structure to be removed or demolished;

(2) A nonrefundable filing fee in the amount of ten dollars which the approving authority may waive or reduce for public agencies;

(3) A faithful performance bond, in either cash or executed by a surety company authorized to do business in the state, in form approved by the city attorney and in an amount as recommended by the director of community development. The bond shall be for the purpose of ensuring that all debris will be removed from the property and the property will be restored to its original state after the demolition and/or removal of the building or structure. If the structures are not removed and the property is not so restored within the time set forth in the permit, then the city may cause the property to be cleared and the bond used for the purpose of paying all costs of demolishing and disposing of any and all structures, material or debris abandoned. 28.80.300 Compliance with city ordinances and the Cerritos building code.

The permit or permits herein authorized shall be, in addition to all permits required under any other ordinance of the city, and the property associated with the demolition applications shall be, subject to the inspection of the city building inspector and shall conform to all ordinances of the city, including, but not limited to, the environmental performance standards and the requirements of the building and safety codes and other codes and ordinances relating to the disconnection of the necessary installation incident to the subject property. 28.80.400 Violation of provisions.

Any violation of the provisions of this chapter related to unsafe or unsightly conditions which have been created by the demolition and/or removal of a structure subsequent to the effective date of the ordinance codified in this chapter is a public nuisance and a misdemeanor punishable as provided for in Chapter 1.08 of this code.
