UNCLAIMED PROPERTY

2.5.01 Police Department to hold for certain period.

All unclaimed property, excepting bicycles, coming into the possession of the Police Department shall be held by the Police Department for a period of at least six (6) months from the date such property comes into possession of the Police Department. Unclaimed bicycles need to be held for only three (3) months. (§ 1, Ord. 314, as amended by § 1, Ord. 91-43, eff. November 6, 1991)

2.5.02 Sale at public auction.

After the required holding period, unclaimed property and unclaimed bicycles may be sold at any convenient time at a public auction to the highest bidder. Any property not bid on and sold at such auction shall be destroyed. (§ 2, Ord. 314, as amended by § 2, Ord. 91-43, eff. November 6, 1991)

2.5.03 Sale at public auction: Notice.

Notice of such sale at public auction shall be given by the Chief of Police by insertion thereof in a newspaper of general circulation. One insertion shall be published on a date at least five (5) days prior to the time fixed for such sale. (§ 3, Ord. 314)

2.5.04 Sale at public auction: Expenses and proceeds.

The expense of the notice of such sale shall be a charge against the City, and any proceeds shall be deposited in the general fund of the City. (§ 4, Ord. 314)

2.5.05 Unclaimed bicycles.

Title to unclaimed bicycles, if no owner appears within three (3) months after such property comes into the possession of the Police Department, shall thereupon vest in the City. The Chief of Police may, at his discretion, donate the unclaimed bicycles to a qualified charitable or nonprofit organization which is actively involved in youth programs. (§ 3, Ord. 91-43, eff.
