10.5.01 Findings and purpose.

This section is intended to comply with Section 115800 of the California Health and Safety Code and to adopt supplemental regulations for the safe use of City-owned and/or operated skate parks, facilities, or structures. The following requirements shall apply to all parks, facilities, and structures owned, operated, maintained, and/or provided by the City for the use of skateboarders and in-line skaters. 10.5.02 Safety equipment.

No person shall use a City-owned or operated skate park without wearing a proper helmet, elbow pads, and knee pads, in compliance with the manufacturer’s recommendations. (Ord. 05-20, eff. July 20, 2005)

10.5.03 Type of skating permitted.

Only skateboards, skates (in-line or quad) and kick scooters approved by the City are allowed in the skate park. Bicycles and other devices are not allowed. A “kick scooter” is defined as a nonmotorized vehicle that has two (2) wheels sized eight inches (8") or smaller with a low footboard between them, is steered by a handlebar, and is propelled by pushing one foot against the ground while resting the other on the footboard. 10.5.04 Skateboarding/in-line skating a hazardous recreational activity.

Skateboarding and in-line skating at City skate park facilities represents a hazardous recreational activity. (Ord. 05-20, eff. July 20, 2005)

10.5.05 Hours of operation.

No person shall use, enter, or be on a City skate park outside of the hours of operation posted at the skate park. (Ord. 05-20, eff. July 20, 2005)

10.5.06 Prohibition of food and beverages.

No person shall cause any food or beverage or food or beverage container to enter a City skate park. (Ord. 05-20, eff. July 20, 2005)

10.5.07 Posting of skate park facility rules.

The General Service Director shall develop appropriate rules of operation and safety for City skate park facilities and affix and maintain signs at City skate parks stating all rules and regulations pertaining to the facility. (Ord. 05-20, eff. July 20, 2005)

10.5.08 Enforcement.

Violators of any of the provisions set forth herein shall be subject to enforcement action as follows:

a.    First offenses: For first time offenses, authorized City personnel should issue a warning to the offender, describing the nature of the offense and desired remedy.

b.    Second offenses: Authorized City personnel should issue a first offense administrative citation to the offending party.

c.    Third and subsequent offenses: Authorized City personnel should issue the next level administrative citation. (Ord. 05-20, eff. July 20, 2005)
