4A-1 Short title.

The ordinance codified in this chapter shall be known as the “reimbursement of incarceration costs measure.” (Ord. No. 428, § 1 (part).)

4A-2 Purpose – Statutory authority.

The purpose of this chapter is to incorporate the provisions of California Penal Code Section 1203.1c, which allows the courts in Colusa County to order, as a condition of probation, that each probationer pay the county the reasonable cost of incarceration in the Colusa jail, including incarceration pending disposition of the case. California Penal Code Section 1203.1c and any subsequent amendments to said section are adopted by the county, and incorporated by reference herein. (Ord. No. 428, § 1 (part): Ord. No. 456, § 1.)

4A-4 Collection of moneys.

The county collector shall be the responsible party for the collection of all said moneys ordered by the court to be paid pursuant to Section 1203.1c of the Penal Code. (Ord. No. 428, § 1 (part).)

4A-5 Deposit of moneys.

All said moneys collected shall be deposited in the general fund of the county. (Ord. No. 428, § 1 (part).)

4A-6 Per-day cost – Designated.

The average per-day cost of incarceration in the Colusa County jail is fixed in the amount of $65.00 and may hereafter be further adjusted as may be necessary from time to time by means of a board of supervisors duly approved resolution setting forth the adjusted average per-day cost rate. 4A-7 Per-day cost – Board of supervisors determination.

The average per-day cost of incarceration as fixed in section 4A-6 shall be reviewed and fixed annually by the board of supervisors. (Ord. No. 428, § 1 (part).)
