52.04.010 Requirements for work in public rights-of-way.

No person shall place, remove or replace any item within the public right-of-way or on public property nor shall a person do or cause to be done any work in the public right-of-way or on public property covered by this title without first having obtained a permit, a City contract or a franchise right to do so. All activities performed under this title shall be done in accordance with conditions of the required permit, City contract or franchise and shall conform to the approved plans, standard drawings, standard specifications, general provisions and other conditions determined by the Director of Public Services as being applicable to the project. This title, however, shall not affect the requirements of any other title of the Municipal Code requiring permits, the payment of fees or the granting of franchises.

52.04.020 Painting or disfiguring City streets prohibited.

Unauthorized persons shall not paint, daub sticky substance, deface, mar or place any sign or advertisement upon any public property or public street or alley.

52.04.030 Trade or obstructions on sidewalks prohibited.

Pedestals, signs, posts, barber poles, railings, barricades and all other obstructions on sidewalks or curbs are hereby prohibited. Nothing in this section, however, shall be deemed to apply to any public utility facilities. (Ord. 2090 § 6 (Exh.), 2019)

52.04.032 Display of goods prohibited on streets and sidewalks.

It is unlawful for any person to set out for exhibition, show or otherwise maintain or allow any goods, wares or merchandise upon any sidewalk or curb, and no person shall place goods, wares, merchandise or other thing of whatever nature between the outer edge of the sidewalk or curb and the property line; provided, however, that the City Council may, at its discretion, permit by resolution such encroachments and make such charges for such permits as it deems advisable.

52.04.038 Loading and unloading of goods.

Nothing contained in CMC 52.04.030 and 52.04.032 shall prohibit the right of any person to load or unload any goods, wares or merchandise in front of the place of business of such person and to leave such goods, wares and merchandise upon the sidewalk or curb for such length of time as is necessary for the purpose of loading or unloading the same.

52.04.040 Obstructing access to business places.

No persons shall block, impede or obstruct any public place or entrance, exit or approach to any place of business in or upon any public place in a manner calculated or with the intent to prevent, delay or interfere with the free passage therealong or therethrough of any other person who is entering, occupying or leaving any place of business, or who is performing any services or labor, purchasing, selling, using, delivering, transporting or receiving any goods, wares, merchandise, services, entertainment, accommodations or articles, or who is attempting or seeking to do any of the foregoing, or to prevent, delay, hinder or interfere with the free passage therealong or therethrough of any vehicle or conveyance operated by or in the custody of any such person, or in which any such other person is riding or attempting to ride.

52.04.050 Dedication of rights-of-way.

No public rights-of-way shall be offered for dedication unless such offer includes the necessary slope easements required for ultimate development of the right-of-way for its intended use, nor shall such an offer or an earlier reservation be accepted for dedication by the City until improvements are reconstructed therein pursuant to this title or their construction is assured.

52.04.060 Urinating/defecating in public prohibited.

A. It is unlawful for any person to urinate or defecate in or upon any street, sidewalk, alley, plaza, park, beach, public building or publicly maintained facility, or in any place open to the public, or in a place the person is exposed to public view.

B. Subsection A of this section does not apply to a person:

1. Who is urinating or defecating in any restroom or other permanent or portable facility designed for the purpose of sanitary disposal of human waste; or

2. Who is unable to comply with subsection A of this section because of a disability or medical condition. (Ord. 1860)
