10.15.010 Definitions.

For the purposes of this chapter, the following words and phrases shall have the meanings respectively ascribed to them by this section:

“Authorized signs” means signs 17 inches by 22 inches minimum size with one-inch-tall minimum size letters, conspicuously posted adjacent to at least two entrances to the subject property. Properties with more than two entrances shall post authorized signs pursuant to a signage plan approved by the chief of police. The authorizing signage plan shall be submitted and reviewed by the chief of police at the time the signed consent form is submitted as provided in Section 10.15.030(c).

“In-line skate” means any vehicle, device, or contrivance with any number of wheels in a straight line attached to a shoe, or other foot gear, which is designed to be propelled by human power, and which is not defined as a bicycle by the California Vehicle Code. The term “in-line skate” also includes motorized in-line skates.

“Property” means all industrial and commercial real property and public property other than highways, public sidewalks, and roadways.

“Property owner” includes the owner, lessee, manager or person with legal authority to control the private property and the city manager with respect to city property.

“Roller skate” means any vehicle, device, or contrivance with any number of wheels attached to a shoe, or other foot gear, which is designed to be, or can be, propelled by human power, and which is not defined as a bicycle by the California Vehicle Code. The term “roller skate” also includes motorized roller skates.

“Skateboard” means any vehicle, device, or contrivance with any number of wheels, with a riding surface of any design, upon which a person may place one or both feet, and which is designed to be, or can be, propelled by human power, and which is not defined as a bicycle by the California Vehicle Code. The term “skateboard” also includes motorized skateboards. (Ord. 2133 § 2, 9-26-95. 1990 Code § 3-15100.)

10.15.020 Riding skateboard, in-line skates, or roller skates on posted property prohibited.

The riding of skateboards, motorized skateboards, in-line skates, roller skates, or other similar devices, as defined in Section 10.15.010, shall be prohibited upon any private or public property when such property has been posted pursuant to this chapter. Property owners are authorized to post or erect signs prohibiting the riding of skateboards, motorized skateboards, in-line skates, roller skates, or similar devices in or on their premises at their own expense. 10.15.030 Warning signs required.

In order to make Section 10.15.020 effective on any property in this city, the property owner shall:

(a)    Erect authorized signs giving notice of the prohibition set forth in Section 10.15.020;

(b)    Have on file with the police department a signed consent form authorizing the police department to enforce Section 10.15.020 on the subject property; and

(c)    Submit and obtain approval of a signage plan from the chief of police where the subject property has more than two entrances.

All posted signs shall contain at least the following text:

Skateboards, Motorized Skateboards, Roller Blades, Roller Skates or Similar Devices Prohibited on Posted Property by FMC Section 10.15.020. Fremont Police Department 790-6800.

10.15.040 Manner of posting.

Authorized signs shall be erected in a manner and in positions so as to prevent vandalism or theft. Failure by a property owner to comply with this section shall not invalidate enforcement actions under this chapter. (Ord. 2133 § 2, 9-26-95. 1990 Code § 3-15115.)

10.15.050 Penalty.

Any violation of this section shall be subject to such penalties as are provided in this code and shall constitute an infraction punishable as herein provided. (Ord. 2133 § 2, 9-26-95. 1990 Code § 3-15120.)
