10.25.010 Authority.

This chapter is enacted pursuant to Cal. Veh. Code § 22507.1. (Ord. 32-2014 § 1, 11-4-14.)

10.25.015 Purpose.1

The city car share program established in this chapter is intended to promote sustainable and alternative transportation practices; alleviate traffic congestion; manage the availability of on-street parking, particularly in areas that will maximize the use of car share vehicles; and thereby improve traffic and parking circulation. 10.25.020 Definitions.

As used in this chapter, unless otherwise apparent from the context, the following words and phrases shall have the following meanings:

“Car share permit” shall mean a permit issued by the department of public works to a car share vehicle of an eligible car share organization that allows that vehicle to park in parking spaces designated for the exclusive use of car share vehicles.

“Car share vehicle” shall mean a motor vehicle that is operated as part of a regional fleet by a public or private car sharing company or organization and provides hourly or daily service.

“City car share program” shall mean a program under which the city designates on-street parking spaces or spaces in off-street public parking facilities for the exclusive use of motor vehicles displaying a valid car share permit.

“Eligible car share organization” shall mean a public or private car sharing company or organization that satisfies the criteria of this chapter. (Ord. 32-2014 § 1, 11-4-14.)

10.25.030 Designation of car share parking spaces.

(a)    Designation of Parking Spaces. The director of public works, or designee, is authorized in accordance with the purposes of this chapter to designate on-street parking spaces or spaces in off-street public parking facilities for the exclusive parking of car share vehicles displaying a valid car share permit.

(b)    Signs or Markings. Upon designation of a parking space or spaces for the exclusive use of car share vehicles pursuant to subsection (a) of this section, the public works department shall place signs or markings giving adequate notice that the parking space or spaces are restricted and to be used only for car share vehicles participating in the city car share program. The signs or markings may state that vehicles left standing in violation of the restriction may be removed. The parking restriction shall not apply to the designated parking spaces until the sign or markings have been placed. (Ord. 32-2014 § 1, 11-4-14.)

10.25.040 Car share permit required.

(a)    No person shall stop, park or leave standing any vehicle in a parking space posted with an official sign or marking stating that the space is for the exclusive parking of car share vehicles participating in the city car share program, unless the vehicle has a valid car share permit displayed as directed by the city.

(b)    The police department is authorized to cite and/or remove or cause the removal of vehicles parked in violation of this section. (Ord. 32-2014 § 1, 11-4-14.)

10.25.050 Car share permit issuance.

The department of public works is authorized to issue car share permits to car share vehicles of eligible car share organizations that allow each permitted car share vehicle to park in parking spaces designated for the exclusive use of car share vehicles. Each permit shall be assigned to a specific car share vehicle. The department of public works shall provide direction to the eligible car share organizations on the proper display of the car share permit. (Ord. 32-2014 § 1, 11-4-14.)

10.25.060 Eligibility criteria for car share company or organization.

Participation in the city car share program is limited to car share companies or organizations selected through a competitive solicitation process, based on criteria including but not limited to the following:

(a)    The car share company or organization must have an online or other similarly accessed real-time system used for processing and paying for car share vehicle reservations;

(b)    The car share vehicles may be accessed where they are parked without requiring a person to go to a different physical location to execute a contract or pick up keys or other access and ignition devices. (Ord. 32-2014 § 1, 11-4-14.)
