2.16.010 Planning commission – Created.

Pursuant to California Government Code Sections 65100 et seq., a planning commission for the city is created. (Ord. 63 § 1, 1989)

2.16.020 Membership and term of office.

A. The planning commission shall consist of five members who shall be appointed by the city council. Each member of the planning commission shall serve a four-year term of office, except for the initial appointment in which two members shall hold a term of office expiring on May 1, 2017 (a two-year term), and three members shall hold a term of office expiring on May 1, 2019 (a four-year term). Initial terms of office shall be determined by lot by the city council upon determination of the planning commission appointment.

B. Except as otherwise set forth herein, the terms and conditions of membership, appointment and removal from the planning commission are set forth in Chapter 2.15 HMC. (Ord. 400 § 2, 2015; Ord. 341 § 2, 2009; Ord. 290 § 2, 2004; Ord. 63 § 2, 1989)

2.16.030 Organization and meetings.

The time, manner and location of meetings, and the selection of chairman and vice chairman of the planning commission shall be as established by resolution of the city council. (Ord. 63 § 3, 1989)

2.16.040 Duties.

The planning commission shall perform the duties and shall have all the rights, powers and privileges specified and provided by the ordinances and resolutions of the city or by state law, and shall serve as the city’s appeals board (see Chapters 2.56, 8.32, 10.20, 15.52, and 16.04 HMC) and as the city’s building appeals board (see Chapter 16.04 HMC). 2.16.050 Compensation.

The members of the city planning commission shall be entitled to reimbursement for all necessary and proper expenses incurred by them in the performance of their duties as members of the planning commission. (Ord. 63 § 5, 1989)

2.16.060 Rescinding certain parts of the development code of the county of San Bernardino.

Those portions and provisions of Division 2, Chapters 1 and 2 of Title 8 of the development code of the county of San Bernardino, as adopted by the city, which are in conflict with the provisions contained herein, are rescinded. Where there is a dispute as to what provisions have been rescinded hereby and are in conflict with the provisions of the development code, such dispute shall be resolved by the city manager.
