6.08.010 Restricted area.

The City Council determines and declares that the following described portion of the City is essentially a residence and business district in which are located many apartments, bungalow courts, and rental properties and the keeping in said district of certain animals prohibited in this chapter is a public nuisance.

The district so referred to consists of all of the City excepting that portion thereof lying north and east of the following described streets:

Commencing at the intersection of Sumner Street with the northwesterly City limits; thence easterly along Sumner Street to its intersection with Spring Street; thence northerly along Spring Street to its intersection with Pottery Street; thence easterly along Pottery Street to its intersection with East Hill Street; thence southerly along East Hill Street to its intersection with Franklin Street; thence easterly along Franklin Street to its intersection with Conklin Avenue; thence southerly along Conklin Avenue, Grove Avenue, Elsinore Height and Mountain View Avenue to its intersection with Railroad Avenue. 6.08.020 Raising animals for commercial purposes prohibited.

It is unlawful for any person, firm, or corporation to keep or raise cats, dogs, rabbits, chickens, pigeons, geese, ducks or turkeys for commercial purposes within that certain portion of the City described in LEMC 6.08.010. Cats or dogs in quantities greater than three, or rabbits, chickens, pigeons, geese, ducks or turkeys in aggregate quantities greater than two shall be conclusively presumed to be for commercial purposes. 6.08.030 Nighttime restrictions.

It is unlawful for any person, firm, or corporation to have or keep between the hours of 6:00 p.m. and 8:00 a.m. of the following day, any roosters or male geese, ducks, turkeys or guineas within that portion of the City described in LEMC 6.08.010. [Ord. 353 § 3, 1954].

6.08.040 Animal-keeping restrictions.

A. It is unlawful for any person, firm, or corporation to keep or maintain within the City limits any horses, cows, sheep or goats within 150 feet of any residence or building used for human habitation; provided, however, that in the event that there is created a subdivision providing for the construction and development as a ranch-type development and in which the developer desires to maintain horses at a distance of less than 150 feet, said person shall make an application to the Planning Commission for an exclusion of the provisions pertaining to the keeping of horses within 150 feet. The Planning Commission shall then act upon said recommendation and forward to the City Council the recommendation. The City Council shall then determine whether or not said provisions shall be waived.

B. It is unlawful for any person, firm, or corporation to keep or maintain within the corporate limits of the City any animals or fowl which habitually make loud noises or interfere with or disturb the peace and quiet of the neighborhood to such an extent as to constitute a public nuisance.
