17.12.020 Suitability of regulations.

In the creation by the ordinance codified herein of the respective classes of districts set forth in this title, the City Council has given due and careful consideration to the peculiar suitability of each and every such district for the particular regulations applied thereto, and the necessary, proper and comprehensive groupings and arrangement of the various uses and densities of population in accordance with a well-considered plan for the development of the City. [Ord. 772 § 17.03.020, 1986. Code 1987 § 17.03.020].

17.12.030 Boundaries – Adopted.

The boundaries of such districts as are shown upon the map adopted by the ordinance codified herein, or amendments thereto, are adopted and approved, and the regulations of this title governing the use of land and buildings, building site areas, the sizes of yards about buildings and other matters as hereinafter set forth, are established and declared to be in effect upon all land included within the respective boundaries of each and every district shown upon said map. [Ord. 772 § 17.03.030, 1986. Code 1987 § 17.03.030].

17.12.040 Boundaries – Determination in case of uncertainty.

Where uncertainty exists as to the boundaries of any district shown on the map adopted in this chapter, the following rules shall apply:

A. Where district boundaries are indicated as approximately following street lines, alley lines or lot lines, such lines shall be construed to be such boundaries.

B. In unsubdivided property or where a district boundary divides a lot, the location of such boundary, unless the same is indicated by dimensions, shall be determined by use of the scale appearing on the map.

C. In case any further uncertainty exists, the Planning Commission shall interpret the intent of the map as to the location of such boundaries.

D. Where any public street or alley is hereafter officially vacated or abandoned, that portion of such street or alley added to any parcel of private land by virtue of such vacation or abandonment shall become a part of the district of which said parcel of private land is a part.

E. Territory annexed to the City subsequent to the effective date of the ordinance codified in this section shall be subject to the provisions of Sections 65858 and 65859 of the Government Code of the State. [Ord. 772 § 17.03.040, 1986. Code 1987 § 17.03.040].

17.12.050 Effect.

Except as hereinafter otherwise provided, the effect of the establishment of the districts shall be as follows:

A. No building, structure, improvement or portion thereof, designed, arranged or intended to be occupied or used for any purpose or in any manner other than those permitted by this title, or amendments thereof, in the district in which such building or structure is located or proposed to be located, shall be erected, constructed, or established, moved, altered, added to, enlarged, or used.

B. No land or lot shall be used for any purposes or in any manner other than those permitted by this title, or any amendments thereto, in the district in which such land or lot is located.

C. No building or structure shall be erected, constructed, structurally altered, built upon to exceed in height the limit for buildings or structures designated for the district in which such building or structure is located, and no building or structure shall be moved into any district where the height of such building would violate the height regulations of the district.

D. No building or structure shall be erected, reconstructed, structurally altered, or moved on any lot or building site as to encroach upon any yard or open space required, or in such a way as to fail to conform to the yard, setback, and open spaces or lot area required for the district in which such building is located.

E. No trailer, trailer home or mobilehome shall be used or occupied within any district of the City except pursuant to the provisions of Chapter 15.44 LEMC, or for any amendments thereto, or for the storage of said trailer, trailer home, or mobilehome, or as may be allowed within the Elsinore State Park, or as hereinafter provided.

A trailer home or mobilehome may be used and occupied within any of the industrial districts; provided, that a written application is made to the City Council, who shall thereafter conduct a special hearing and may grant or deny said application at its sole discretion. In the event that a conditional exception is granted by the City Council, it shall have the power to grant such exception for such period of time as it may in its sole discretion determine and upon such other terms and conditions as said City Council may require.
