CERTIFICATE OF OCCUPANCY1:

11-3.1 Required; Grounds For Issuance:

It shall be unlawful for any person to move into any new building or part of a new building, or into any new addition to an existing building, or into any building in which structural alterations or repairs have been made, for the purpose of occupying the same unless there has been issued by the building official a certificate of occupancy, specifying the particular type or class of occupancy for which the building or part of a building may be used. A certificate of occupancy shall be issued only when the building or part of a building, or any alterations or repairs, have been completed and finally inspected by the building official and have been found by him to comply with all requirements of this code and other ordinances of the city, including the building code adopted in this chapter and with the laws of the state, for the particular use or occupancy specified in such certificate. 11-3.2 No Fee For Certificate Of Occupancy:

No fee shall be charged for a certificate of occupancy required by this chapter. (Code 1972 §8-10)

11-3.3 Procedure Upon Change Of Type Of Occupancy:

Whenever it is proposed to install in any building or part of a building a different type or class of occupancy from that installed therein immediately prior thereto, the person proposing the change of occupancy shall notify the building official thereof. The building official shall then cause the building to be reinspected and, if it is found to comply with all requirements of this code and other ordinances of the city, including the building code adopted in this chapter and all laws of the state pertaining to the proposed new type or class of occupancy, he shall either note such fact on the building card for the building in the files of the building department or, if he is requested to do so, he shall issue a new certificate of occupancy covering the proposed new use. It shall be unlawful for any person to occupy any building or part of a building for a different type or class of occupancy than that specified in the certificate of occupancy for the building or noted on the building card for such building as provided in this subsection. 11-3.4 Color Review:

a. Residential Zones: No person shall paint or otherwise color the exterior of any residentially zoned property for a second story addition or a new residential dwelling unit without first obtaining a permit from the development services department, planning division.

b. Commercial And Manufacturing Zoning Districts: No person shall paint or otherwise color the exterior of any building or structure in a commercial or manufacturing zoning district along Long Beach Boulevard, Atlantic Avenue, Martin Luther King Jr. Boulevard, State Street, Abbott Road, Bullis Road, Wright Road, Alameda Street, Lynwood Road or Imperial Highway without first obtaining a permit from the development services department, planning division.

c. Application: An application for such a permit shall be submitted to the development services department, planning division, on a form provided.

d. Approval Of Application: The permit shall be granted if the development services department, planning division finds that the color or colors for the project are within a range of colors that has been approved by the city council. The city council, in approving a color range, shall eliminate only such colors as would be injurious to and adversely affect the aesthetic goals for the designated areas.

e. Denial Of Permit: Any person who is denied a permit may appeal to the planning commission by filing a notice thereof within fifteen (15) days after receiving notice of the development services department, planning division decision. The development services department, planning division shall schedule the matter before the planning commission at the next available meeting after receiving notice of the appeal. The decision of the planning commission shall be final.

f. Fee: The fee for the permit shall be designated by resolution of the city council.

g. Standards: Standards to paint a new building, addition or repaint an existing building shall be as follows:

1. The primary color of buildings shall be limited to an earthen hue background color, which is integral or applied consistently to the material. Colors include off whites, light grays, beiges, tans, browns or other similar subdued tones, shades or colors to include colors on approved city of Lynwood color charts.

2. Special architectural features and trim may use brighter colors as an accent. Colors shall complement the body color of the building, as well as highlight decorative details (e.g., trims, ornaments, fascias, inlays, tile, ironwork, awnings and other architectural features), as determined by the development services department, planning division.

3. Other elements on the building and property should be compatible and/or architecturally integrated with the color and design scheme of the primary building (e.g., roofs, fences and walls, signs, trash enclosures) and any other accessory structures or features.

h. Nonconforming Colors: Nonconforming colors shall be permitted to remain unless one of the following occurs:

1. A new residence or commercial/industrial structure is developed; or

2. A second story residential addition or usable floor area in commercial or manufacturing zones is constructed.

i. Prohibited Colors: Prohibited colors shall include, but not be limited to:

1. Fluorescent colors; or

2. Bright colors (i.e., red, yellow, orange, pink, purple); or

3. An excessive combination and/or amount of colors; or

4. Colors inconsistent with surrounding areas; or

5. Colors that may reduce property values or negatively impact properties in vicinity as determined by the development services department, planning division, or the planning commission.

j. Exemptions:

1. Any existing structure previously painted prior to the adoption hereof. (Ord. #1319, §2; Ord. #1546, §1)
