DESIGN AND IMPROVEMENT REQUIREMENTS.1

24-7.1 Design of Streets.

Major and secondary highways shall conform in width and substantially in alignment with that shown or indicated in the general plan of highways of the County or with the master plan of the City. All other streets and roads shall conform in width and alignment and shall be of a design designated by the City Council. (Code 1972, §29-45)

24-7.2 Alleys.

Alleys having a minimum width of twenty (20') feet shall be provided at the rear of all lots classified for commercial use unless adequate off-street parking areas to serve such property are reserved for such purposes and are shown upon the final map and approved by the City in the manner herein provided. Alleys in the rear of lots classified for commercial use shall be paved with macadam or equal material to a width of at least fifteen (15') feet. Alleys elsewhere shall be optional. 24-7.3 Overhead Utilities.

Overhead utilities shall be located at the rear of lots along either alleys or easements, wherever practicable. (Code 1972 §29-47)

24-7.4 Lots.

Lots shall have a minimum area of approximately six thousand (6,000) square feet and an average minimum width of fifty (50') feet. No lot shall be divided by a County or City boundary line. Side lines of lots shall be approximately at right angles to the street line on straight streets or to the tangent on curved streets. (Code 1972 §29-48)

24-7.5 Blocks.

Blocks less than four hundred (400') feet in length or more than eight hundred (800') feet in length may be cause for disapproval of the tentative map, but in no case shall they be longer than one thousand three hundred twenty (1,320') feet. (Code 1972 §29-49)

24-7.6 Pedestrian Ways.

In long blocks, pedestrian ways may be required. Where pedestrian ways are required, such ways shall be paved and shall be at least five (5') feet in width. (Code 1972 §29-50)

24-7.7 Water Distribution Facilities.

a. The subdivider shall submit to the City Engineer two (2) copies of plans and specifications showing the proposed water system in the subdivision. The plans and specifications shall conform to standard requirements of the City Water Department and shall bear the approval of the City Engineer, prior to any construction.

b. All water distribution systems referred to in paragraph a. of this subsection shall be constructed by and at the expense of the subdivider. (Code 1972 §29-51)

24-7.8 Off-Street Parking.

Special areas for the off-street parking of motor vehicles, offered for dedication or to be otherwise reserved for public use in connection with proposed business, industrial, unlimited multiple residential or institutional property, shall receive special attention as to size, location, shape and general adequacy. (Code 1972 §29-52)

24-7.9 Dedication of Public Ways and Places.

a. All streets, highways, alleys and parcels of land shown on the final map and intended for any public use shall be offered for public use.

b. Dedications offered but refused for immediate acceptance, if necessary for future need and when declared to be so, shall be designated on the final map as “dedicated for future street” or other public facility as the case may be.

24-7.10 Improvement or Agreement to Improve Required Facilities Prerequisite to Final Map Approval.

The subdivider shall improve, or agree to improve, all land dedicated for streets, highways, public ways and easements as a condition precedent to acceptance thereof and approval of the final map. Improvements required are set forth in this section. (Code 1972 §29-54)

24-7.11 Improvements To Be at the Expense of the Subdivider.

All sidewalks, curbs, gutters, pavements, water mains, culverts, drainage structures and sanitary sewers where existing laterals are available within a reasonable distance shall be constructed by and at the expense of the subdivider. Some or all of these requirements may be waived by the Council in the case of major highways or secondary highways. (Code 1972 §29-55)

24-7.12 Deposit for Inspection of Improvements.

Before commencing any improvement, the subdivider shall deposit with the City Engineer a sum estimated by the City Engineer to cover the actual cost of inspection of all improvements under his jurisdiction. Any unused portions of the deposit shall be returned to the subdivider after completion and acceptance of the work. (Code 1972 §29-56)

24-7.13 Agreement to Complete Improvements; Bond or Insurance.

a. If improvements required by this section are not completed to the satisfaction of the City Engineer prior to final approval of the map, the subdivider shall enter into an agreement with the Council to complete such work.

b. An agreement made pursuant to paragraph a. shall be accompanied by a faithful performance bond guaranteeing the faithful performance of all work, in a penal sum which, in the opinion of the City Engineer, equals the cost thereof. The agreement shall also be accompanied by a bond or policy of insurance protecting the City against damage or injury to persons or property growing out of, related to or resulting from improvements or work; the bond or policy of insurance shall be in such amount and in such form as the City Engineer may from time to time require.

24-7.14 Final Parcel Checking Fee.

In addition to all other fees and charges required by law upon submitting the final map under the provisions of the Subdivision Map Act of the State to the County Engineer, the subdivider shall pay to the County Engineer the final parcel checking fee. The amount of this fee shall be determined by a resolution of the City Council and may, from time to time, be adjusted in accordance with the agreement executed between the County Engineer and the City Council.
