TEMPORARY SEWER SERVICE

3.15.010 Temporary sewer service.

(1) The District will consider providing temporary sewer service based on a sewerage emergency to property owners who own property outside the District’s boundaries but within the District’s sphere of influence on a first come first served basis upon submittal by the property owner of a request for a temporary sewer service connection and documentation of the actual presence of contaminated soils, groundwater, or standing sewage. This documentation may include any of the following: results of physical sampling, certifications by wastewater professionals, notices or demands from regulatory or health-related agencies of the local, County or State governments or public concerns documented by physical evidence of contamination.

(2) The property owner requesting a temporary sewer service connection will be responsible for all costs and expenses involved in documenting that a sewerage emergency exists, reviewing the request for temporary sewer service, preparing agreements for providing the temporary sewer service, and installing the temporary sewer service connection. The property owner will deposit funds with the District estimated to cover these services. All funds deposited will be retained by the District until the request has been evaluated and acted on, or until installation of the temporary sewer service connection, if approved. All unused portions of the deposit will be returned to property owner, without interest, upon completion of the processing of the request, or the completion of installing the temporary sewer service connection if the request is approved. If the deposit does not cover all costs for services provided by the District, the property owner will promptly pay to the District the amount incurred by the District that exceeds the deposit.

(3) The Board will consider the request within 30 working days from the date the property owner submits all documentation necessary for the District to evaluate the request. Upon a finding of a sewerage emergency and confirmation that the District has capacity to provide sewer service to the property, the Board will establish the conditions of the temporary sewer service connection and will direct staff to install a temporary sewer service connection. The property owners must immediately pay all fees and charges then required for connection to the District’s sewer system, including fees related to the expansion of capacity in the Paradise Drive area.

(4) The property owner must enter into an agreement, which will be recorded, with the District that establishes the terms and conditions for the temporary sewer service, including that the temporary sewer service will be for a period of one year unless extended by the Board of Directors. Property owners must agree to allow the placement of a lien on the property to cover all costs, charges and fees the property owner may owe to the District.

(5) The District will be responsible for the disconnection of all temporary sewer service connections and property owners will fully reimburse the District for all costs involved in terminating the temporary sewer service.

(6) The District does not support the annexation of property it provides temporary sewer service to under this chapter because of the District’s ongoing concerns about its sewer treatment capacity at the Playa Verde Treatment Plant.

(7) The resolution codified in this chapter will remain in effect for as long as the District has capacity at the Playa Verde Treatment Plant or until it is changed by the Board of Directors. [Res. 2004-10.]
