PRIVATE WATER METERS

3.20.010 Private water meters.

(1) Private water meters shall continue to be permitted to be utilized by commercial facilities to demonstrate the volume of discharge that does not enter into the District’s collection system on the following conditions:

(a) Any facility seeking to utilize private meter data for billing reductions shall have the burden of proving the meter measures only water that does not enter the District’s collection system.

(b) Any facility seeking to utilize private meter data for billing reductions shall have the responsibility of providing the District with accurate monthly meter readings for the previous calendar year (January through December) not later than July 1st of the following year.

(i) If any facility fails to timely submit a complete list of monthly readings, they shall no longer be permitted to use a private water meter to demonstrate the volume of discharge that does not enter into the District’s collection system and is thereby appropriately subtracted from annual flow for billing calculation purposes. They may, however, then utilize a MMWD meter for such purpose.

(c) Any facility seeking to utilize private meter data for billing reductions shall provide the District with a certified third-party flow calibration of the subject meter at a frequency no less than every five years.

(i) If any facility fails to timely submit the proof of calibration required herein, they shall no longer be permitted to use a private water meter to demonstrate the volume of discharge that does not enter into the District’s collection system and is thereby appropriately subtracted from annual flow for billing calculation purposes. They may, however, then utilize a MMWD meter for such purpose.

(d) The District shall have the absolute right to independently verify private meter readings, but said right creates no obligation to do so on the District’s part.

(2) If any private water meter utilized by a commercial facility to demonstrate the volume of discharge that does not enter into the District’s collection system fails, said facility shall install a Marin Municipal Water District meter if they wish to continue seeking credit for water alleged to not enter into the District’s collection system.

(3) In regards to the San Francisco Yacht Club:

(a) The private meter credit given for financial year 2011/2012 shall remain;

(b) No private meter credit shall be given for financial year 2012/2013 due to the failure to submit adequate data; and

(c) Prorated private meter credit shall be given for financial year 2013/2014 for months for which meter data can be provided in compliance with this chapter. [Res. 2013-14.]
