2.40.010 Finding.

It is found, determined, and declared that there is a need for a redevelopment agency to function in the city in accordance with the provisions of the Community Redevelopment Law, being California Health and Safety Code Section 33000 et seq. (Ord. 520, § 1; 1976 Code § 2-8.01).

2.40.020 Establishment of agency – Powers.

The redevelopment agency is established pursuant to Section 33101 of the California Health and Safety Code.

The redevelopment agency is authorized to transact business and exercise its power under provisions of the Community Redevelopment Law. (Ord. 520, § 1; 1976 Code § 2-8.02).

2.40.030 Name.

The redevelopment agency established herein is designated as the “redevelopment agency of the city of Millbrae.” (Ord. 520, § 1; 1976 Code § 2-8.03).

2.40.040 Designation of city council as agency – Declarations and findings.

The city council declares itself to be the redevelopment agency of the city pursuant to the provisions of Section 33200 of the California Health and Safety Code.

The city council further declares that all of the rights, powers, duties, privileges, and immunities of the said Community Redevelopment Law are vested in the city council.

This declaration is based upon the finding that the Millbrae city council presently has the greatest ability to expedite and facilitate the requirements of the Community Redevelopment Law in a timely manner consistent with the needs, goals, and objectives of the community.

The city council further finds and determines that the designation of the city council as the redevelopment agency will serve the public interest and promote the public health, safety, and welfare in an effective manner in that this public body is best able to serve the needs of the community to implement the purposes of the Community Redevelopment Law. (Ord. 520, § 1; 1976 Code § 2-8.04).

2.40.050 Salary – Expenses.

That inasmuch as the population of the city is less than two hundred thousand, compensation of the members of the redevelopment agency is established pursuant to Section 33114.5 of the California Health and Safety Code, as such section may be amended from time to time. Provided, however, that no member shall receive compensation for attending more than four meetings of the redevelopment agency during any calendar month. In addition, members shall receive their actual and necessary expenses incurred in the discharge of their duties. (Ord. 520, § 1; 1976 Code § 2-8.05).
