5.12.010 License – Required.

There are imposed upon the businesses, trades, professions, callings and occupations specified in this chapter license taxes in the amounts hereinafter prescribed, and it is unlawful for any person to transact and carry on any business, trade, profession, calling or occupation in the City of Mt. Shasta without first having procured a license from said City so to do or without complying with any and all applicable provisions of this chapter. (Ord. 407 § 10, 1983)

5.12.020 License – Application.

(A) Applicants for permit and license under this title must file with the City Clerk a sworn application in writing (in duplicate) on a form to be furnished by the City Clerk, which shall give the following information:

(1) Name of licensee;

(2) Mailing address of licensee;

(3) Street address;

(4) Specific type of license required;

(5) Phone number;

(6) Date issued;

(7) Date expires;

(8) Fee provided by MSMC 5.28.____;

(9) Type: New ___ Renewal ___;

(10) License fee $____;

(11) License No. _____;

(12) Date paid ____;

(13) License issued for the following:

First quarter;

Half year;

Third quarter;

Annual;

(14) If license is for the following, indicate number of units:

Hotel ________;

Motel ________;

Trailer Court ________;

(15) State occupational or professional license number, if required: _______________ for the following occupation or profession: ______________________.

(B) All applicants requiring peddlers, solicitors or canvasser license must be fingerprinted by the Police Department of the City of Mt. Shasta for the purpose of establishing moral and character references, for the protection of the public. (Ord. CCO-96-07 §§ 32, 33, 1996; Ord. 407 § 50, 1983)

5.12.030 License – Issuance.

Every person required to have a license under the provisions of this chapter shall make application for the same to the City Clerk of the City of Mt. Shasta, and upon the payment of the prescribed tax the City Clerk shall issue to such a person a license which shall contain:

(A) The name of the person to whom the license is issued;

(B) The business licensed;

(C) The place where such business is to be transacted and carried on;

(D) The date of the expiration of such license; and

(E) Such other information as may be necessary for the enforcement of the provisions of this chapter. (Ord. 407 § 11, 1983)

5.12.040 License – Proration.

Annual, semiannual and quarterly licenses may be issued for the unexpired portion of the license period. The fee charged the licensee for the unexpired portion of a license period shall be the sum of the monthly rates for the number of months remaining in the license period; fractions of months shall be counted as whole months. 5.12.050 License – Requirements.

Each applicant, or, if other than an individual, its representative, must at all times retain in his or her personal possession the license issued by the City Clerk and must produce and show the same on the demand of any person solicited or of any police officer of the City of Mt. Shasta. No licensee shall alter, remove, or obliterate any entry made upon a license or deface a license in any way. Each license shall be personal and nonassignable or transferable, nor shall any license be used by any person other than the licensee or the person for whom issued. (Ord. 407 § 52, 1983)

5.12.060 License – Expiration.

All annual licenses issued under the provisions of this title shall expire on the thirtieth of June in the year when issued. Other than annual licenses shall expire on the date specified in the license. (Ord. 407 § 59, 1983)

5.12.070 License – Revocation.

(A) Permits and licenses issued under the provisions of this title may be revoked by the City Clerk of the City of Mt. Shasta after notice and hearing, for any of the following causes:

(1) Fraud, misrepresentation, or false statement contained in the application for license;

(2) Fraud, misrepresentation or false statement made in the course of carrying on his business as solicitor or as canvasser;

(3) Any violation of this title;

(4) Conviction of any crime or misdemeanor involving moral turpitude;

(5) Conducting the business of soliciting, or of canvassing, in an unlawful manner or in such a manner as to constitute a breach of the peace or to constitute a menace to the health, safety or general welfare of the public; or

(6) Conducting the business in violation of State occupational licensing laws, or of any other law, regulation, or ordinance.

(B) Notice of the hearing for revocation of a license shall be given in writing, setting forth specifically the grounds of complaint and the time and place of hearing. Such notice shall be mailed, postage prepaid, to the licensee at his last known address at least five days prior to the date set for hearing. (Ord. CCO-96-07 § 34, 1996; Ord. 407 § 57, 1983)

5.12.080 Appeal.

Any person aggrieved by the action of the City Clerk in the denial or revocation of a permit or license, or in the assessing of the fee, as provided in this chapter, shall have the right of appeal to the City Council. Such appeal shall be taken by filing with the City Clerk, within 14 days after notice of the action complained of has been mailed, to such person’s last-known address, a written statement setting forth fully the grounds for the appeal. The City Council shall consider the appeal, and may in its discretion do so on the basis of the filed statement of the appellant, or allow testimony at a hearing on the same. The City Council may, by resolution, establish the amount of a fee for the filing of such appeals. (Ord. CCO-96-07 § 35, 1996; Ord. 407 § 58, 1983)

5.12.090 Existing licenses.

A license issued to any person under the provisions of any other ordinance of the City of Mt. Shasta, the license provisions of which ordinance are superseded by the provisions of this title or which has been repealed by this title, shall remain in full force and effect until the expiration date thereof, at which time said person shall obtain and pay the license fee established herein, subject, however, to all other provisions of this title made applicable to said business.
