6.06.010 Purpose.

The purpose of this chapter is to prevent the unauthorized taking of recycling containers and recyclable materials. (Ord. CCO-90-02, 1990)

6.06.020 Definitions.

(A) “Approved recycling container” means the bucket, bag, box or other container supplied by and/or identified by the City, the authorized recycling contractor, or the donor of recyclable materials, as the container into which recyclable materials shall be placed for curbside collection, or for use at authorized dropsite locations.

(B) “Authorized recycling contractor” means a person, firm, partnership, corporation or other entity authorized under and by virtue of a contract with the City to collect recyclable materials within the City limits, or, if it authorizes itself to make such collections, the City itself.

(C) “Recyclable material” means material such as, but not limited to, paper, glass, metals, used motor oil, cardboard and plastic in whatsoever form, and including newspapers, magazines, cans, bottles and cartons which are separated from each other or from other garbage or refuse.

(D) “Recycling” means the process of collecting used products for purpose of reusing, reprocessing or remanufacturing them.

(E) “City” means the City of Mt. Shasta.

(F) “Authorized dropsite locations” means any of one or more places inside or outside the City limits, designated by the City as locations where recyclable materials shall be delivered by donors for eventual removal and recycling by an authorized recycling contractor.

(G) “Person” means any individual or business entity. (Ord. CCO-90-02, 1990)

6.06.030 Ownership of recyclable materials.

(A) Recyclable material placed at the curbside, or elsewhere, for collection by an authorized recycling contractor is and remains the property of the person who placed it there until such time as the authorized recycling contractor takes possession of it, at which time it shall become the property of said contractor.

(B) Recyclable material placed at an authorized dropsite location for collection by an authorized recycling contractor becomes the property of said contractor upon being left at the dropsite by the person who placed it there. (Ord. CCO-90-02, 1990)

6.06.040 Unauthorized collection prohibited.

No person other than an authorized recycling contractor shall remove recyclable material which has been placed at the curbside, at any dropsite location, or elsewhere, except with the express permission of the owner of such material. Any and each violation hereof from one or more locations shall each constitute a separate and distinct offense, punishable as provided in this chapter. (Ord. CCO-90-02, 1990)

6.06.050 Taking recycling materials prohibited.

(A) It shall be unlawful for any person to burn, break, destroy, scatter, scavenge, collect or take any recyclable materials without the express permission of the owner of the material; provided, however, that nothing herein shall prohibit any person, with the express permission of the occupant of private property, from collecting or scavenging recyclable materials left thereon without such occupant’s consent, nor from collecting or scavenging recyclable materials left on public property and neither inside, nor in the immediate vicinity, of an authorized recycling container or dropsite location.

(B) The scavenging or collection by any person of cans, bottles, paper, etc., from places on public lands where they have not been separated from other garbage or refuse is specifically encouraged. (Ord. CCO-90-02, 1990)

6.06.060 Taking recycling containers prohibited.

It shall be unlawful for a person other than the occupant of the premises where the same is located, or the City, or an authorized agent of the City, or the authorized recycling contractor, to remove, take, destroy, damage or deface any approved recycling container from a curbside or dropsite location. 6.06.070 Right to dispose of recyclable materials.

Nothing in this chapter shall limit the right of a person to donate, sell or otherwise dispose of recyclable materials; provided, that any such disposal is in compliance herewith. (Ord. CCO-90-02, 1990)

6.06.075 Disposal of unauthorized materials.

No person shall deposit in any approved recycling container any material other than the recyclable material designated for such container. (Ord. CCO-90-02, 1990)

6.06.080 Violations and penalties.

Repealed by Ord. CCO-20-04. (Ord. CCO-90-02, 1990)

6.06.090 Civil actions.

Nothing in this chapter, nor any conviction hereunder, shall limit the right of an authorized recycling contractor, or any other person, to bring a civil action against any person who violates any provision of this chapter. (Ord. CCO-90-02, 1990)
