9.20.010 Statement of purpose.

The purposes of this chapter are to:

(A) Regulate barking and other noises by dogs within the City, so as to allow citizens thereof the peaceable use, occupancy, or enjoyment of their homes and businesses; and

(B) Require persons having dogs to maintain the premises on which they are kept in a clean and sanitary condition, for the benefit of both the dog kept therein and the public welfare. (Ord. CCO-92-04, 1992)

9.20.020 Definitions.

In this chapter, the following definitions shall apply:

(A) “City” means the City of Mt. Shasta.

(B) “Person” means an individual, or a corporation or other associated group of individuals or business entities.

(C) “Unreasonably noisy” means noise which is frequently, easily and readily heard on the property of other persons, and which would be disturbing to the normal peaceful use, occupancy, or enjoyment of the property of such other persons, considering the use to which the property is being put, the time of day, and other relevant factors.

(D) “Owner” also includes persons who have possession or control of a dog. (Ord. CCO-92-04, 1992)

9.20.030 Noisy dogs prohibited.

The owner of a dog shall not allow it to bark, howl, whine, or in any other way to be unreasonably noisy, as that term is defined in MSMC 9.20.020. (Ord. CCO-92-04, 1992)

9.20.040 Provocation.

A dog which is being provoked to make noise by the immediate visible or audible presence of the complaining party, or other persons, or animals not within the control of the owner of the dog, shall not be deemed to be unreasonably noisy under this chapter. (Ord. CCO-92-04, 1992)

9.20.050 Feces.

The owner of a dog shall not allow the feces thereof to be deposited on public or private property other than the property of the said owner; provided, however, that it shall not be permitted to accumulate on the property of the owner. Feces which are readily perceptible by odor on any adjoining property shall be deemed to have been allowed to accumulate in violation of this section. (Ord. CCO-92-04, 1992)

9.20.060 Violations – Penalties.

9.20.080 Civil remedies.

Any affected person may bring a civil action against the owner of a dog, based on violation of this chapter, seeking legal and/or equitable relief, if such action is otherwise permitted under law. Nothing in this chapter shall be deemed to create a cause of action against the City. (Ord. CCO-92-04, 1992)

9.20.090 Citation.
