10.44.010 Definitions.

The definition of terms and names used in this chapter shall be set forth in the current edition of the California Vehicle Code as of the time of the alleged violation. (Ord. CCO-94-05, 1994; Ord. 400 §§ 1 – 5, 1982)

10.44.020 Obstructing street maintenance.

It is unlawful for any person, firm, corporation or association to park or leave standing, attended or unattended, any vehicle as defined in Cal. Veh. Code § 670, or any amendment to that section, upon any street, avenue, public parking area or alley within the City of Mt. Shasta, County of Siskiyou, State of California, at any time, or in any manner, which shall obstruct, hinder, delay or otherwise inconvenience the plowing or removal of snow, sweeping or cleaning, repairing or construction of streets, avenues, public parking area and alleys and repairing or installation of underground utilities within the City of Mt. Shasta. (Ord. 384 § 3, 1981)

10.44.030 Removal of obstructing vehicle.

Any police officer of the City shall have the right to remove any such vehicle so parked or left attended or unattended on any street, avenue, public parking area or alley within the City of Mt. Shasta during, or preparatory to, operations of snow plowing, street sweeping, street repair or construction, underground utility repair or construction, and to store the same or cause the same to be stored at the expense of the owner or person in charge thereof. 10.44.035 Penalty for violation of MSMC 10.44.020 and 10.44.030.

10.44.040 Removal of vehicle from storage.

It is unlawful for any person or persons to remove any vehicle stored by the Mt. Shasta Police Department in accordance with this chapter without first obtaining permission from the Police Department and paying towing and storage fees due the City of Mt. Shasta. The fees are as follows: first 48 hours of storage, $2.50 and a $35.00 towing fee. There shall be an additional $1.00 storage fee for every 24 hours over 48 hours. The aforementioned fees may be changed from time to time by resolution. (Ord. 384 § 5, 1981)

10.44.050 Penalty for violation of MSMC 10.44.040.

10.44.060 Curb markings.

Curb markings shall be made by the City in accordance with Cal. Veh. Code § 21458, or any successor statute, which currently provides:

(A) Red curb: no stopping, standing, or parking, except for buses so designated;

(B) Yellow curb: stopping only for the purpose of loading or unloading, and subject to posted time restrictions;

(C) White curb: stopping only for the deposit of mail into an adjacent mailbox, and subject to posted time restrictions;

(D) Green curb: parking duration limited by posted time restrictions;

(E) Blue curb: parking exclusively limited to the vehicles of disabled persons who have the placard prescribed by law for parking in handicapped parking spaces. (Ord. CCO-97-01, 1997)

10.44.070 Parking prohibited.

Vehicle parking shall be prohibited at each of the locations described hereinbelow:

(A) Alma Street: from the southerly most line of Assessor’s Parcel Number 57-321-060.

(B) Ida Street: between Mt. Shasta Boulevard and A Street; south side; all vehicles prohibited.

(C) Lake Street: a distance of 15 feet from each point of tangency of the curb radius, at the intersection of Chestnut Street, on both sides of Lake Street.

(D) McCloud Avenue: on the south roadway edge of the eastbound lane of McCloud Avenue between the intersections of Mt. Shasta Boulevard and Washington Avenue.

(E) Ski Village Drive: between Wertz Road and Old Highway 99; north and south sides; no parking between signs; all vehicles prohibited.

(F) Ream Avenue: between Court Street and Mt. Shasta Boulevard; east side of street; all vehicles prohibited.

(G) Chestnut Street: a distance of 40 feet from the point of tangency of the curb radius, at the west corner of the intersection with East Lake Street.

(H) Pine Street: first parking space on the west side of Pine Street north of West Lake Street (one space).

(I) North Mt. Shasta Boulevard: for 30 feet south of Reginato Road on the east side of Mt. Shasta Boulevard in front of 1044 North Mt. Shasta Boulevard (two residential spaces).

(J) North Mt. Shasta Boulevard: for 20 feet south of Ivy Street on the east side of Mt. Shasta Boulevard in front of 630 North Mt. Shasta Boulevard (one space).

(K) North Mt. Shasta Boulevard: for 20 feet north of East Ivy Street on the east side of North Mt. Shasta Boulevard in front of 724 North Mt. Shasta Boulevard (one space).

(L) South Mt. Shasta Boulevard: for 20 feet north of Sisson Street on the west side of South Mt. Shasta Boulevard in front of 625 South Mt. Shasta Boulevard (one space).

(M) North Mt. Shasta Boulevard: one space between 912 and 924 North Mt. Shasta Boulevard.

(N) Other: any other parking area for which the City Council has heretofore, by resolution, or does hereafter, pursuant to this chapter, direct that the curb be painted red and/or that “no parking” signs be posted. 10.44.080 Parking restricted.

Vehicle parking shall be restricted and limited at the locations described hereinbelow, in the manner specified:

(A) Chestnut Street: two-hour limitation from 9:00 a.m. to 6:00 p.m., except Sundays and State holidays:

East Side –

From Alma Street to East Castle Street;

 

From East Lake Street to Orem Street;

West Side –

From Alma Street to East Castle Street;

 

From East Lake Street to East Castle Street;

 

From East Lake Street to 125 feet south.

(B) Mt. Shasta Boulevard: two-hour limitation from 9:00 a.m. to 6:00 p.m., except Sundays and State holidays:

East Side –

From Alma Street to East Castle Street;

 

From East Castle Street to East Lake Street;

 

From East Lake Street to Chestnut Street;

West Side –

From Alma Street to West Castle Street;

 

From West Castle Street to West Lake Street;

 

From West Lake Street to Alpine Street.

(C) Maple Street: two-hour limitation from 9:00 a.m. to 6:00 p.m., except Sundays and State holidays:

East Side –

From West Lake Street extending 125 feet north;

 

From West Lake Street extending 100 feet south;

West Side –

From West Lake Street extending 125 feet north.

(D) Alma Street: two-hour limitation from 9:00 a.m. to 6:00 p.m., except Sundays and State holidays:

North Side – From Mt. Shasta Boulevard to Chestnut Street;

South Side – From Mt. Shasta Boulevard to Chestnut Street.

(E) East Castle Street: two-hour limitation from 9:00 a.m. to 6:00 p.m. (applies to curbside parking only), except Sundays and State holidays:

North Side –

From Mt. Shasta Boulevard to Chestnut Street;

South Side –

From Mt. Shasta Boulevard to Chestnut Street;

Center Median –

Four-hour limitation from 9:00 a.m. to 6:00 p.m. (applies to Center Median parking only), except Sundays and holidays. From North Mt. Shasta Boulevard to Chestnut Street.

(F) West Castle Street: two-hour limitation from 9:00 a.m. to 6:00 p.m., except Sundays and State holidays:

North Side – From Maple Street to Mt. Shasta Boulevard;

South Side – From Mt. Shasta Boulevard to first alley west of Mt. Shasta Boulevard.

(G) West Lake Street: two-hour limitation from 9:00 a.m. to 6:00 p.m., except Sundays and State holidays:

North Side – From Maple Street to first alley east of Maple Street;

South Side – From Maple Street to Mt. Shasta Boulevard.

(H) East Lake Street: two-hour limitation from 9:00 a.m. to 6:00 p.m., except Sundays and State holidays:

Both Sides – From Mt. Shasta Boulevard to Chestnut Street.

(I) McCloud Avenue: no truck (excluding pickup trucks), trailer, or motor home parking, both sides of street, between Mt. Shasta Boulevard and Washington Drive.

(J) Lake Street: no truck (excluding pickup trucks), trailer, or motor home parking, both sides of street, between Chestnut Street and Alder Street.

(K) Orem Street: no truck (excluding pickup trucks), trailer, or motor home parking, both sides of street, between Chestnut Street and Washington Drive.

(L) Mt. Shasta Boulevard: no parking from 2:00 a.m. to 6:00 a.m., every day, both sides of street, between Chestnut Street and Alma Street.

(M) North Mt. Shasta Boulevard:

(1) No pickup, truck, trailer or motor home parking east side of street starting at 910 North Mt. Shasta Boulevard heading north for 300 feet.

(2) No parking permitted for tractor-trailers, recreational vehicles, motor homes or vehicles over seven feet in height on the east side of the street between Alma Street and East Jessie Street.

(N) Use of Public Streets or Public Parking Lots for Storage of Vehicles, Vessels or Trailers Prohibited.

(1) No person who owns or has possession, custody or control of any vehicle, vessel or trailer shall park or leave it standing upon any prohibited street, alley or public parking lot for 72 or more consecutive hours without advance authorization by the City Manager or his/her designee.

(2) In the event a vehicle is parked or left standing upon any prohibited street, alley or public parking lot for 72 or more consecutive hours without advance authorization by the City Manager or his/her designee, a peace officer or designated Mt. Shasta employee may remove the vehicle, vessel or trailer from the street, alley or public parking lot in a manner subject to the requirements of the California Vehicle Code.

(3) For the purposes of this section, a vehicle, vessel or trailer shall be considered to have been parked or left standing for 72 or more consecutive hours if it has not been moved at least 500 feet during such 72-hour period.

(4) Prohibited 72-Hour Parking Zones.

(a) North Mt. Shasta Boulevard between Ivy Street and McCloud Avenue.

(b) South Mt. Shasta Boulevard between McCloud Avenue and Bear Springs Road.

(c) Chestnut Street between McCloud Avenue and Ivy Street.

(d) Lake Street between Chestnut Street and Pine Street.

(e) Maple Street between Lake Street and Castle Street.

(f) Castle Street between Chestnut Street and Maple Street.

(g) Alma Street between Pine Street and Chestnut Street.

(h) Alpine Street between Mt. Shasta Boulevard and Mill Street.

(i) Public parking lot at East Castle Street between North Mt. Shasta Boulevard and Chestnut Street.

(j) Public parking lot at West Lake Street between North Mt. Shasta Boulevard and Maple Street.

(k) Public parking lot at Alma Street between North Mt. Shasta Boulevard and Pine Street.

(l) Public parking lot at Chestnut Street between Lake Street and Castle Street.

(5) Restricted Time Parking.

(a) No parking between the hours of 10:00 p.m. and 6:00 a.m. daily at the Sisson Youth Baseball ballpark parking area on the west side of Everett Memorial Highway between Washington Drive and Rockfellow Drive and east of Sisson Elementary School with the following exceptions:

(i) During time when the parking area is designated for snow removal as determined by the Director of Public Works, typically from November 1st to April 30th.

(ii) With written permission from the City Manager or their designee.

(O) Other. Any other parking area for which the City Council has heretofore, or does hereafter, direct that parking restrictions shall be posted or painted.

(P) Implementation. City staff are authorized and directed to cause the herein designated areas to be identified with appropriate signage and/or curb painting. City staff are authorized to establish a permit process for residences that front on two-hour parking streets. (Ord. CCO-23-09, 2023; Ord. CCO-23-07, 2023; Ord. CCO-06-06, 2006; Ord. 10.44.090 Parking or standing prohibited.

The parking or standing of vehicles shall be prohibited at the locations described hereinbelow.

(A) Alma Street: between the front of radio station KWSD/KEDY and Rockfellow Drive. (Ord. CCO-94-05, 1994; Ord. 264 §§ 1, 5, 1967)

10.44.100 Signage.

No citation for a violation of this chapter shall issue unless there is in place a sign, or curb paint, which is reasonably visible and legible to the subject vehicle operator, or unless the person to be cited has been otherwise informed, in advance, of the prohibition or restriction. Any curb painted red shall constitute notice to vehicle operators that no vehicle shall be left parked or standing adjacent thereto. Any curb painted yellow, with a recitation of the maximum parking time limit, e.g., “10 minutes,” or words to that effect, shall constitute notice to vehicle operators that parking adjacent thereto is restricted under this chapter. 10.44.110 Private postings or curb markings.

Except as provided herein, no person shall post any parking restrictions, or mark any curb, on or in relation to parking, stopping, or standing on any public street, alley, or way. (Ord. CCO-97-01, 1997)

10.44.120 Posting of time restrictions.

The time restrictions referred to in MSMC 10.44.100 may be by signage or by printing the same legibly on the adjacent marked curb. (Ord. CCO-11-05 § 30, 2011; Ord. CCO-97-01, 1997)

10.44.130 Amendments.

The locations and restrictions described in this chapter may be deleted or amended, and additional locations and restrictions may be prescribed, by the procedure set forth in MSMC 10.44.100 and 10.44.140. Written notice of the proposed change shall, not later than three days before the meeting at which an amending ordinance is to be introduced, be mailed to those persons whose names appear on the City utility customer list for each location with frontage within the area to be changed; provided, however, that no failure to notify an individual customer shall affect the validity of an otherwise duly adopted ordinance. 10.44.140 Placement of posting and marking restrictions.

The City Department of Public Works shall have the responsibility of posting signs and marking curbs in accordance with the directives of the City Council, and for the subsequent repair and maintenance of the same. (Ord. CCO-97-01, 1997)

10.44.150 Emergency provisions.

In the event of an emergency or other situation which constitutes a hazard to persons or property, the City Chief of Police, or his nominee in his/her absence, may prescribe additional temporary locations for the prohibition or regulation of parking or standing. Such temporary probation or regulation shall not exceed seven days in length. No notice to affected property owners or occupants shall be required, but within 24 hours of adopting such an emergency provision, the Chief of Police shall send written notice thereof to each City Council member. Appropriate posting or signage shall be installed for any temporary location. (Ord. CCO-94-05, 1994)

10.44.160 Loading only.

No person shall park or leave standing any vehicle, except for loading or unloading, with a maximum time limit of 15 minutes, in any alley within the City of Mt. Shasta. Additionally, no vehicle shall be parked in any alley within the City of Mt. Shasta to constitute an obstruction to emergency or service vehicles. (Ord. CCO-05-02, 2005; Ord. CCO-94-05, 1994)

10.44.161 Parking of vehicles/vessels for sale.

(A) No person shall park or place a vehicle or vessel or other personal property upon a public or private street, parking lot or any public or private property for the purpose of displaying such vehicle, vessel or other personal property thereon for sale, hire or rental. This section shall not apply if the real property is properly zoned by the City for such purpose, the vendor is duly licensed to transact such business at that location, and the vendor owns or has lawful possession of the real property or has written permission in his/her possession and posted on the personal property from the owner or person in lawful possession of the real property to vend the personal property at the location.

(B) Subsection (A) of this section shall not prohibit any person from parking or placing a vehicle or vessel or other personal property on private residential property belonging to or occupied by the owner of such vehicle, vessel, or other personal property, for the purpose of displaying same for sale, hire or rental or from displaying a “for sale, hire or rental” sign, not in violation of the California Vehicle Code, on a vehicle while the vehicle is being used for normal transportation.

(C) “Vehicle” as used in this section means a “vehicle” as defined in Cal. Veh. Code § 670, as the same now reads or may hereafter be amended.

(D) “Vessel” as used in this section means a “vessel” as defined in Cal. Veh. Code § 9840(a), as the same now reads or may hereafter be amended.

(E) The parking or placing of any vehicle or vessel or other personal property with a sign or other advertising device thereon or proximate thereto, indicating such vehicle or vessel or other personal property is for sale, hire or rental, shall constitute prima facie evidence that such vehicle, vessel, or other personal property was parked or placed for the purpose of displaying same for sale, hire or rental.

(F) In any prosecution for violation of this section against the registered owner of a motor vehicle or vessel, proof that the particular vehicle or vessel described in the complaint was in violation of this section, together with proof that the defendant named in the complaint was at the time the registered owner of the vehicle or vessel, shall constitute prima facie evidence that the registered owner of the vehicle or vessel was the person who placed the vehicle or vessel at the point, and for the time during which, the violation occurred. The foregoing provisions apply only when the notice procedure as established by Cal. Veh. Code § 40202, as the same now reads or may hereafter be amended, is complied with.

(G) Any charge under this section shall be dismissed when the person charged submits proof that such person has made bona fide sale or transfer of the vehicle or vessel and has delivered possession thereof to the purchaser and has complied with the requirements of subdivision (a) or (b) of Cal. Veh. Code § 5602 or subdivision (a) or (b) of Cal. Veh. Code § 9905 prior to the date of the alleged violation and has advised the court of the name and address of the purchaser, and of the date of sale. (Ord. CCO-05-02, 2005)

10.44.162 Parking space markings – Single space use required – Exceptions.

(A) The City Public Works Director is authorized to install and maintain parking space markings to indicate parking spaces adjacent to curbings where authorized parking is permitted.

(B) When such parking space markings are in place on the roadway, subject to other more restrictive limitations, no vehicle shall be stopped, left standing or parked other than within a single space.

(C) This section shall not apply to any commercial vehicle making pickups or deliveries of goods, wares and merchandise from or to any building or structure located on a restricted street during the period of time reasonably necessary to complete such work; delivering materials to be used in the actual and bona fide repair, alterations, remodeling or construction of any building or structure upon a restricted street for which a building permit has previously been obtained; or to emergency parking of disabled vehicles, to public utility vehicles performing work operations, or to other commercial vehicles exempted by State law from parking restrictions, or during times when the width of the street has been narrowed due to construction or inclement weather.

(D) Any vehicle or combination of vehicles exceeding 22 feet in length and requiring more than one single marked parking space shall park in designated on-street parking areas, or curbside parking areas outside the marked parking space zones.

(1) Designated on-street parking areas for vehicles or combination of vehicles exceeding 22 feet in length:

(a) Alma Street – South Side – From Chestnut Street east-bound to first alley (100 feet).

(b) Alma Street – Between Pine Street and railroad tracks on both sides.

(c) Maple Street – West Side – Between Lake Street and Alpine Street.

(d) Maple Street – East Side – North-bound from Alpine extending 60 feet north.

(e) Mill Street – West Side – Between Alpine Street and Water Street.

(f) Mill Street – East Side – North-bound from Water Street extending 100 feet north. (Ord. CCO-05-02, 2005)

10.44.170 Penalties.

Except as may be otherwise provided herein, a violation of this chapter shall result in a civil penalty, as set forth in Chapter 1.03 MSMC, Enforcement of Code, to be levied once for each calendar day during which the violation took place. (Ord. CCO-94-05, 1994)

10.44.180 Removal of vehicle.

In addition to the penalty provided by MSMC 10.44.170, any vehicle left standing or parked in violation of this chapter may be removed from the prohibited or restricted area by order of any City police officer, the Director of Public Works, or the City Administrator, and may thereupon be taken to a place to be designated by the said City official. A vehicle so removed and stored shall be subject to reasonable removal and storage charges before release to its owner, and such charges shall constitute a lien thereon, recoverable in the manner provided in the California Civil Code. 10.44.190 Additional restrictions.

In addition to the procedure set forth in MSMC 10.44.130, amendments to the parking locations and restrictions set forth in this chapter may be adopted by resolution of the City Council, to take effect immediately, but such amendments shall expire within 120 days unless they are renewed by another resolution or an ordinance amending this chapter has been approved by the Council.
