13.70.010 Assessment of drainage improvement charges.

Drainage improvement charges shall be assessed at the time of issuance of a building permit for structures. Said charge shall be assessed and paid as a condition precedent to the approval of the parcel map, or final map, in the case of subdivision or tract development. (Ord. CCO-99-05, 1999; Ord. 13.70.020 Use of drainage improvement charges.

Drainage improvement funds shall be maintained in accounts designated by the City officer for that purpose, and their use shall be restricted to expenditures for drainage improvement projects, and including the administration thereof. (Ord. CCO-99-05, 1999; Ord. CCO-93-04, 1993; Ord. 358, 1978)

13.70.030 Amount of drainage improvement charges.

Drainage improvement charges shall be calculated as follows:

RESIDENTIAL

Single-family residence

$200.00/structure

(1.00 residential equivalent)

Duplex

$250.00/structure

(1.25 residential equivalent)

Triplex

$300.00/structure

(1.50 residential equivalent)

Fourplex

$400.00/structure

(2.00 residential equivalent)

Four units and over

$400.00 plus $25.00 each additional unit over four

(2.00 residential equivalent plus $0.25 for each unit over four)

COMMERCIAL

$500.00 for the first 5,000 square feet of coverage including parking areas and drives; plus $0.05 for each additional square foot up to 10,000 square feet; plus $0.02 for each additional square foot over 10,001 square feet

13.70.040 Drainage user fees.

A drainage user fee shall be collected from the owner of each improved assessor’s parcel within the City. For the purposes of this section, an “improved parcel” is any parcel upon which any structure has been erected, or upon which any paved parking lot has been constructed. (Ord. CCO-99-05, 1999; Ord. 13.70.050 Use of drainage user fees.

Drainage user fees shall be restricted in use to maintenance and repairs of existing and future drainage systems and related projects. (Ord. CCO-99-05, 1999; Ord. CCO-93-04, 1993; Ord. 358, 1978)

13.70.060 Amount of drainage user fees.

Drainage user fees are established at $1.00 for each single-family residential equivalent, as defined in MSMC 13.70.030. All other monthly rates shall be as follows: $1.00 for the first 5,000 square feet of lot coverage, plus $0.25 for each 5,000 square feet or fraction thereof in excess of 5,000 square feet. For the purposes of this section, the term “lot coverage” means the area which is covered by any structure or paved area including decks, porches, and stairs; but excluding any roof overhang area. 13.70.070 Collection of user fees.

The Finance Officer, or his/her designee, is authorized to collect drainage user fees, and to do so, at his/her option, along with other monthly user fees for City services, in the manner and according to the provisions set forth in MSMC 13.04.040 through 13.04.080. 13.70.080 Amendment of fees.

The drainage improvement fees and user fees set forth herein may be amended by resolution of the City Council to provide for collection of the actual cost of providing drainage services. (Ord. CCO-99-05, 1999; Ord. CCO-93-04, 1993; Ord. 358, 1978)

13.70.090 Late charges.

The City Clerk may adopt and collect late charges, penalties, and/or interest, for the payment of fees provided hereunder, in accordance with MSMC 13.04.040 through 13.04.080. (Ord. CCO-99-05, 1999; Ord. CCO-93-04, 1993; Ord. 358, 1978)
