2.08.010 Establishment Authority.

The Council-Manager form of government is established by Article III of the City Charter. (Ord. 1060, 1963: 1949 Code § 2300)

2.08.020 Bond for Manager Pro Tempore.

Any person serving as Manager Pro Tempore during the absence or disability of the City Manager, shall furnish a corporate surety bond conditioned upon the faithful performance of the duties of the office in the same form and amount as is required of the City Manager. 2.08.030 Compensation—Expenses.

In addition to the compensation fixed by the City Council, the City Manager shall be reimbursed for all sums necessarily incurred or paid by the City Manager in the performance of the City Manager’s duties within the amounts fixed in the budget for such purposes and for the City Manager’s expenses incurred when traveling on business pertaining to the City under the direction of the City Council. 2.08.040 Powers and Duties.

In addition to the powers and duties set out in the Charter, the City Manager shall have the power and be required:

A.    To see that all franchises, permits and privileges granted by the City, and the provisions of all contracts to which the City is a party, are faithfully observed;

B.    To consolidate or combine duties, offices, positions, departments or units under the City Manager’s direction within the limits established by the City Charter, this Code, or the annual budget, and subject to City Council approval; provided, however, that nothing herein contained shall be construed to supersede the authority of the Civil Service Board in the matter of classification of City officers or employees subject to Civil Service or prohibit the City Manager from authorizing the Assistant City Manager to perform the duties of a Department Director for a limited term;

C.    To attend all meetings of the City Council unless excused therefrom by the City Council;

D.    To recommend to the City Council for adoption such measures and ordinances as the City Manager deems necessary or expedient;

E.    To make investigations into the affairs of the City, and any department or division thereof under the City Manager’s direction and control;

F.    To investigate as necessary all complaints and other matters concerning the administration of the City government;

G.    To close or restrict access to any and all public property owned or controlled by the City during the pendency of any construction, repair, remedial, maintenance or modification work on public property upon reasonable notice to the public posted at or near the site of the proposed work;

H.    To exercise general supervision over all public buildings, public parks, and other public property which are under the control and jurisdiction of the City Council and not specifically delegated to a particular board or officer;

I.    To avoid all activities outside the City government which are inconsistent with the policies of the City Council or the duties of the City Manager’s office;

J.    To provide leadership for civic movements designed to benefit the residents of the City when so authorized by the City Council;

K.    To perform such other duties and exercise such other powers as may be delegated to the City Manager from time to time by ordinance or resolution of the City Council. (Ord. 2023-22 § 47, 2023; Ord. 97-1 § 1, 1997: Ord. 1060 (part), 1963: 1949 Code § 2303)

2.08.060 Subject to Civil Service Provisions.

The exercise of the powers and duties of the City Manager herein, and the provisions of this chapter, shall be subject to the Civil Service provisions of the City. (Ord. 1060 (part), 1963: 1949 Code § 2305)
