CHAPTER 2
DEFINITIONS

The following words and phrases shall be construed throughout this Code as defined herein unless from the context a different meaning is intended, or unless a different meaning is specifically defined:

1.2.002 City.

"City" means the area within the territorial limits of the City of Oakley.

1.2.004 City Manager.

"City Manager" means the City Manager of the City of Oakley, or his or her designee.

1.2.006 Civil Code Provisions.

"Civil Code Provisions" The provisions of Sections 13 and 14 of the Civil Code of the State of California are adopted for the interpretation of words and phrases, unless otherwise provided herein.

1.2.008 Council.

"Council" means the City Council of the City of Oakley.

1.2.010 County.

"County" means the County of Contra Costa.

1.2.012 Days.

"Days" means calendar days.

1.2.014 Gender.

"Gender" The feminine gender includes the masculine and neuter genders; and the masculine gender includes the feminine and neuter genders.

1.2.016 Graffiti.

"Graffiti" means the intentional spraying of paint or marking of paint, ink, chalk, dye or other similar substances upon private or public property without permission of the owner of the property.

1.2.018 May.

"May" is permissive; "shall" is mandatory.

1.2.020 Number.

"Number" The singular includes the plural and vice versa.

1.2.022 Nuisance.

"Nuisance" is defined in Section 1.6.102.

1.2.024 Oath.

"Oath" includes affirmation.

1.2.026 Office.

"Office" The use of the title of any officer, employee, or any office or ordinance means such officer, employee, office or ordinance of the City of Oakley, unless otherwise specifically designated.

1.2.028 Person.

"Person" means any natural person, firm, association, joint venture, joint stock company, partnership, organization, club, company, corporation, business trust, or their manager, lessee, agent, servant, officer or employee, or any of them.

1.2.030 State.

"State" means the State of California.

1.2.032 Tenses.

Words used in the present tense include the past and future tenses and vice versa.

1.2.034 Use of Words and Phrases.

Words and phrases used in this Code and not specifically defined shall be construed according to the context and approved usage of the language.
