INTOXICATION

4.11.002 Public Consumption of Alcoholic Beverages.

a.    No person shall consume any alcoholic beverage in any quantity on any public street, avenue, boulevard, sidewalk, alley or public parking lot, or on private parking lots, shopping centers, or other commercial properties open to the general public, unless expressly permitted pursuant to subsection (b) of this section.

b.    This subsection shall not apply to those areas and at such times as the City Council has granted temporary use and occupancy of public streets and has permitted the possession and consumption of alcoholic beverages or has approved the possession and consumption of alcoholic beverages on private parking lots, shopping centers or other commercial properties open to the general public. In addition to City Council approval, all other required permits and licenses must be obtained.

c.    For purposes of this subsection, "alcoholic beverage" means and includes alcohol, spirits, liquor, wine, beer and every liquid containing alcohol, spirits, wine or beer.

d.    Any person violating this chapter shall be guilty of an infraction.
