V. Offenses Against Property

BILL POSTING AND PAINTING ON PROPERTY

9.24.010 Prohibited on utility poles—Exception.

It is unlawful for any person, firm or corporation to place or affix, in any manner whatsoever, any poster, sign, notice, card, advertisement or announcement, of any character whatsoever, on any electrolier, telephone pole, or any pole used for the support of electric light or power wires or for any other purpose connected with the transmission or distribution of electric energy, within the corporate limits of the city, or to paint, letter or stencil any words, figures, pictures or signs on such electrolier or pole; provided, however, that it is not unlawful for the person, firm or corporation maintaining any such poles used for the purposes aforesaid, to paint, letter or stencil thereon such identifying words or figures, or such warning notices as are customarily placed on poles used for similar purposes by the person, firm or corporation maintaining same. 9.24.020 Prohibited on trees, fences, buildings or other structures without consent.

No person, firm or corporation shall paint, letter or stencil any sign, words, figures or pictures on any tree, fence, wall, building or other structure other than those mentioned in Section 9.24.010 within the corporate limits of the city, or place or affix thereon, in any manner whatsoever, any poster, sign, notice, advertisement or announcement, of any character whatsoever, unless such person, firm or corporation be, or shall have received the previous consent of, the owner or lessee of such tree, fence, wall, building or structure. 9.24.030 Penalty for violation.

Any person violating any provision of this chapter shall be guilty of an infraction and on condition thereof shall be subject to the following fines:

A.    Thirty dollars upon the first offense;

B.    Fifty dollars upon the second offense;

C.    Two hundred dollars upon the third offense and each subsequent offense.

If any violation be continued, each day’s violation shall be deemed a separate violation. (Ord. 558 § 1, 1996: Ord. 254 § 1, 1974: Ord. 49 § 3, 1923).
