9.12.010 Definitions.

For the purposes of this section, the following words shall have the meanings set out in this section:

A. “Explosive” is defined as any chemical compound or any mechanical mixture which when ignited by fire, friction, concussion, percussion, detonator or any other means causes a sudden or rapid combustion, causing violent expansion of the air or gases and accompanied by a report. The term “explosives” includes fireworks and “safe and sane fireworks,” and includes but is not limited to devices designated by the manufacturer as fireworks, torpedoes, skyrockets, roman candles, rockets, daygo bombs, sparklers, party poppers, paper caps, chasers, fountains, smoke sparks, aerial bombs, fountains, spike fountains, whistles, handle fountains, California candles, ground spinners, or ground spinning devices, wheels – vertical, wheels – horizontal, toy smoke devices, flitter devices, and fireworks kits.

B. “Fire” means to explode, discharge or impel by using compressed air, heat, percussion or electric spark.

C. “Firearm” means any device or weapon from which a missile, such as, but not limited to, a bullet, ball or shell, is hurled by compressed air or explosive. (Ord. 648 § 2, 2007; Ord. 37 § 2, 1981; Ord. 29 § 1, 1981; CC § 33.101(a))

9.12.020 Prohibition.

No person shall fire any firearm or explode any explosive within the City. (Ord. 37 § 2, 1981; Ord. 29 § 1, 1981; CC § 33.101(b))

9.12.030 Exceptions.

This section does not apply to firearms fired under the authority of the United States, the State, or the City, nor to shooting galleries or target ranges; nor where a permit has been issued or a firing area designated by the City Council pursuant to PMC 9.12.040 and 9.12.050. 9.12.040 Permits.

The Director of Safety Services may issue written permits to fire firearms or explode explosives upon such terms and under such conditions as he or she deems proper. The terms and conditions imposed by the Director shall be set forth on the face of any permit issued under this section. (Ord. 710 § 2, 2010; Ord. 37 § 2, 1981; Ord. 29 § 1, 1981; CC § 33.101(d))

9.12.050 City Council may designate special areas.

The City Council, by resolution, may designate certain areas within the City in which it is lawful to fire firearms upon such terms and under such conditions as the Council deems proper. (Ord. 37 § 2, 1981; Ord. 29 § 1, 1981; CC § 33.101(e))
