1.20.010 Enforcement authority.

A.    The city manager and his or her designee shall have the authority to enforce Ordinances 340, 394, 486, 816, 819, and Chapters 5.04, 5.08, 5.16 and 15.32 of this code, as may be amended from time to time.

B.    The fire chief (Riverside County fire department/San Jacinto fire) and designated employees of the fire department shall have the authority to enforce Ordinance 815 of the city, as may be amended from time to time. (Ord. 1063 § 1, 1999: Ord. 938 § A, 1991: prior code § 1.12.010)

1.20.020 Arrest—Citation authority.

City employees noted in Section 1.20.010 of this chapter are authorized, pursuant to California Penal Code Section 836.5, to arrest persons and to prepare, issue and deliver to any arrested persons, written notice to appear in court and to release such persons from custody upon receiving from him or her his or her written promise to appear in court for any violation of the city ordinances cited. 1.20.030 Scope of authority.

Section 1.20.010 of this chapter shall not have the function of changing the status of the named employees from a miscellaneous employee to a peace officer or safety employee for the purpose of retirement, worker’s compensation or other similar injury or death benefits. (Prior code § 1.12.030)

1.20.040 Incorporation of state statutes.

This chapter incorporates the California Penal Code Chapter 5(c), commencing with subsection 8.53.5, and Chapter 5(d), commencing with subsection 853.9, in their entirety for the official procedures governing the issuance of citations and complaints. (Prior code § 1.12.040)
