9.16.010 Definitions.

For the purposes of this chapter, the words set out in this section shall have the following meanings:

A.    “Public agency” includes the state, the county and any city or district therein, and any departments or officers thereof.

B.    “Telephone number” includes any additional numbers assigned by a public utility company engaged in the business of providing communications services and facilities to be used by means of a rotary or other system to connect with the subscriber to the primary number when said number is in use. 9.16.020 Use subject to consent of public agency.

No person within the city shall use or operate, cause to be used or operated, arrange, adjust, program or otherwise provide or install any device or combination of devices that will, upon activation, either mechanically, electrically, automatically, or by any other means initiate an intrastate telephone call and deliver a recorded message to any telephone number as-signed to a public agency within the city without the agency’s prior written consent. 9.16.030 Withdrawal of consent of public agency.

The public agency may withdraw its consent by written notice to the person to whom the consent was given and such person shall have the device disconnected within seven days of receipt of said written notice of withdrawal. (Ord. 626 § 2, 1971)
