10.32.010 Definitions.

Whenever the following words are used in this chapter they shall have the following meanings ascribed to them:

A.    “Major arterial” means the following areas in the city of San Pablo:

1.    San Pablo Avenue from city limit(s) to city limit;

2.    Rumrill Boulevard from San Pablo Avenue to Richmond city limit;

3.    San Pablo Dam Road from San Pablo Avenue to County line;

4.    23rd Street from San Pablo Avenue to Richmond city limit;

5.    El Portal Drive from city limit to San Pablo Avenue.

B.    “Cruise” or “cruising” shall mean the repetitive driving of a motor vehicle past a traffic-control point in traffic which is congested at or near the traffic-control point, as determined by the ranking peace officer on duty within the affected area, within a specified time period and after the vehicle operator has been given an adequate written notice that further driving past the traffic-control point shall be a violation of this chapter.

C.    “Highway” and “motor vehicle” are defined in California Vehicle Code Sections 360 and 415 respectively. (Ord. 86-006 § 1 (part), 1986)

10.32.020 Cruising prohibited.

A.    Cruising is prohibited on streets classified as major arterials.

B.    No person shall be guilty of cruising unless:

1.    That person has passed the same traffic-control point twice within a two-hour period and has been given written notice on the second driving trip past a traffic-control point that further driving past the traffic-control point shall be a violation of this chapter of the municipal code; and

2.    Notice is posted on the streets subject to cruising controls as set forth in Section 10.32.030. (Ord. 86-006 § 1 (part), 1986)

10.32.030 Signs.

Signs shall be erected, at the beginning and end of the portion of the street subject to cruising control, that briefly and clearly state the appropriate provisions of this chapter. (Ord. 86-006 § 1 (part), 1986)

10.32.040 Exclusions.

This chapter does not apply to in-service emergency vehicles, taxicabs for hire and buses. (Ord. 86-006 § 1 (part), 1986)

10.32.050 Penalty.

Violation of this chapter shall be an infraction punishable as provided in Section 1.08.020 of the San Pablo Municipal Code. (Ord. 86-006 § 1 (part), 1986)
