SIDEWALK OBSTRUCTIONS

12.12.010 Rubbish, filth, garbage and obstructions—Duty of owner or occupant to keep sidewalk clear.

It shall be the duty of every person owning or occupying any lot or block of land in the city which is bounded on any side thereof by any legally established sidewalk, lane or alley, to keep such sidewalk or alley free from all rubbish, filth, garbage and obstructions of every kind, and as far as the edge of such sidewalk nearest to the street and as far in length as the corresponding dimensions of such lot or block. 12.12.020 Rubbish, filth, garbage and obstructions—Owner or occupant permitting accumulations guilty of maintaining nuisance.

Any owner or occupant of any lot or block of land in the city bounded on any side by any legally established sidewalk, lane or alley, who places or causes to be placed, or suffers or permits to be placed, or permits to accumulate on any street, sidewalk, lane or alley so adjoining his premises, any rubbish, filth or garbage or obstruction of any kind or description, shall be guilty of maintaining a public nuisance. 12.12.030 Rubbish, filth, garbage and obstructions—Persons depositing on street guilty of committing nuisance.

Any person who throws, deposits or places any rubbish, filth, garbage or obstruction of any kind, except as provided in Section 12.12.040, in or upon any public street, lane, sidewalk or alley shall be guilty of committing a public nuisance. (Prior code § 14.7: Ord. 98 § 1 (part)).

12.12.040 Rubbish, filth, garbage and obstructions—Exemption to provisions.

The provision with reference to accumulations of rubbish and like material on sidewalks and alleys, set out in Sections 12.12.010 through 12.12.030, shall not be construed so as to prevent any person from depositing goods, wares and merchandise upon any sidewalk, lane or alley in the city for the purpose of immediately conveying them across the same; provided, that no goods, wares, or merchandise shall remain on any sidewalk longer than is necessary for the purpose of unloading and conveying them across the same, and after they have been so conveyed they must not be replaced thereon except for the purpose of prompt delivery thereof. 12.12.050 Exceptions to prohibitions.

No person shall cause to be placed or place upon any public way, street or sidewalk, anything which obstructs or prevents the use of any portion of such street or sidewalk; provided, that this section shall not apply to:

A.    Goods or merchandise in actual course of receipt, delivery or removal;

B.    Poles, posts or hydrants erected and maintained by permission or order of the council or the superintendent of streets;

C.    Poles or standards for flags or banners used during any celebration or public occasion for decorative and patriotic purposes when placed in sockets set in sidewalk not more than eight inches from curb;

D.    Ornamental trees planted along the outer line of the sidewalk and within the curb, and barriers for the protection of the same;

E.    Materials used in the construction or repair of any building where permission has been obtained from the superintendent of streets;

F.    Coin rack newspaper stands at locations recommended by the council;

G.    Benches for use of customers of public transportation on such curbs and at such places and under such conditions as may be ordered from time to time by the council. (Prior code § 25.4: Ord. 98 § 2 (part)).

12.12.060 Damaging street lights or warning signals unlawful.

It is unlawful to break, extinguish or injure any light maintained for street lighting or as a warning signal of any dangerous place on the roadway or the sidewalk of the street. (Prior code § 25.1: Ord. 98 § 2 (part)).

12.12.070 Barrier required around dangerous portion of street or highway.

Any person by whom, or under whose direction or authority, as principal, or as contractor, or employer, any portion of a public street, alley, roadway or thoroughfare may be made dangerous shall erect, and so long as the danger continues, maintain around the portion of the street or highway so made dangerous, a good and substantial barrier. 12.12.080 Erecting business stands or other obstructions prohibited.

No person shall erect, place or maintain any business stand or other obstruction on any portion of any street, sidewalk or alleyway of the city. (Prior code § 25.3)

12.12.090 Obstructing free passage on sidewalks prohibited.

Any number of persons gathered together in one place so as to interrupt the free passage of travel on any of the sidewalks or pavements in the city is liable to arrest alike and shall be punished for committing a nuisance. (Prior code § 18.25)

12.12.100 Carrying materials offensive to pedestrians on sidewalks prohibited.

No person upon any sidewalk shall carry, so as to be offensive to pedestrians, any rubbish, garbage or filth. (Prior code § 14.8)
