15.13.050 Definitions.

A “bicycle” shall have the same definition as set forth in SMC 15.12.010 and is also defined to include any motorized electric bicycle or “powered scooter.”

As used in this chapter, the “downtown area” is defined as those areas of public property within 539 Bridgeway and 833 Bridgeway and those public streets and public rights-of-way east of Bridgeway (Tracy Way, Bay Street, Anchor Street, and Humboldt Street) and west of Bridgeway on Princess Street up to 62 Princess Street.

A “parked bicycle” in violation of this section is defined as any unattended bicycle locked to or leaning against a pole, tree, other bike or any other object not commonly used for the purpose of securing bicycles or any bicycle that is left unattended in areas not designated as bicycle parking during the “peak bike period.”

The “peak bike period” is defined as 11:00 a.m. to 7:00 p.m.

A “powered scooter” shall mean any two-wheeled device that has handlebars, has a floorboard that is designed to be stood upon when riding, and is powered by an electric motor or other power source. This device may also have a driver seat that does not interfere with the ability of the rider to stand and ride and may also be designed to be powered by human propulsion. A motorcycle as defined in California Vehicle Code Section 400, a motor-driven cycle as defined in California Vehicle Code Section 405, or a motorized bicycle or moped as defined in California Vehicle Code Section 406 is not a powered scooter. [Ord. 1260 § 2, 2018; Ord. 1233 § 1, 2016; Ord. 1222 § 1, 2014.]
