2.64.010 Created.

The Solana Beach parks and recreation commission is created as an advisory commission to the city council. General provisions of the commission are referenced in Chapter 2.60 SBMC, unless otherwise specified. (Ord. 370 § 1, 2008; Ord. 119 § 1, 1990)

2.64.020 Membership and terms.

A. The parks and recreation commission shall consist of seven members. All members shall be appointed by the city council at large. The term of office shall be two years. Members may be appointed to successive terms. Additional terms may be added by resolution.

B. Ex Officio Members. The recreation supervisor shall be an ex officio member of the commission. Ex officio members shall be entitled to attend all meetings of the commission and to participate in all discussions but shall not be entitled to a vote or to serve as an officer of the commission other than secretary and shall not be counted for the purpose of establishing a quorum. The recreation supervisor or such other person as may be designated by the city manager shall be the principal staff of the commission. (Ord. 370 § 1, 2008; Ord. 119 § 1, 1990)

2.64.030 Duties.

The parks and recreation commission shall have the power, and it shall be the duty of the commission, to make recommendations to the city council and to advise the council and city manager on matters pertaining to the creation, operation, maintenance, use, management and control of community recreational programs and activities, parks, beaches and other indoor and outdoor recreational facilities and areas. The commission may also advise the city manager through the recreational supervisor regarding recreational programs or activities provided or proposed to be provided by the city, including such matters as types of programs and activities, fees and charges for participants, scheduling and other similar matters. 2.64.040 Powers delegated to the parks and recreation commission to be advisory.

Nothing in this chapter shall be construed as restricting or curtailing any of the powers of the city council, or as a delegation to the parks and recreation commission of any of the authority or discretionary powers vested and imposed by law in the city council. The city council declares that the public interest, convenience and welfare require the appointment of a parks and recreation commission to act in a purely advisory capacity to the city council for the purposes enumerated. Any power herein delegated to the commission to adopt rules and regulations shall not be construed as a delegation of legislative authority but purely a delegation of administrative authority. 2.64.050 Funds – Disposition of moneys.

A. Funds Generally. The parks and recreation commission is authorized to and may receive donations, gifts, legacies, endowments or bequests made to the city or to the commission for or on behalf of the city for the acquisition of parks and recreation facilities and the construction, maintenance and operation of any of the foregoing facilities, subject to the approval of the city council.

B. Gifts Paid to Treasurer. All donations, gifts, legacies, endowments or bequests so received by the commission shall be turned over to the city treasurer, and shall be kept in a special fund to be designated as the parks and recreation fund.

C. Parks and Recreation Account. The city council shall establish an account in the general fund to be known as the “parks and recreation account.” There shall be deposited to and expended from this account all fees from the operation of recreational programs or moneys received by the commission, including the proceeds from all gifts, legacies or bequests as set forth in subsection B of this section and including the proceeds of other sources managed or controlled by the commission and derived by it in connection with the operation of the public recreational activities and facilities under its jurisdiction. All moneys in the account shall be used for parks and recreational purposes, their promotion and not otherwise, and if not used during any current year, shall accumulate in the parks and recreation account.
