2.74.010 Created.

The Solana Beach view assessment commission is hereby created as an advisory commission to the city council as referenced in Chapter 17.63 SBMC. General provisions of the commission are referenced in Chapter 2.60 SBMC, unless otherwise specified. (Ord. 370 § 2, 2008)

2.74.020 Membership and terms.

A. The view assessment commission shall consist of seven persons who shall serve at the pleasure of the city council. Members shall be appointed by the city council with each member of the council being entitled to appoint one member and the two additional members to be selected by the council at large. Members shall be appointed by the city council and vested with authority to administer Chapter 17.63 SBMC. The terms of office shall be two years. In addition to the requirement of residency, as stated in the general provisions in Chapter 2.60 SBMC, the member shall be a property owner within the city of Solana Beach. Additional terms may be added by resolution.

B. Ex Officio Members. The community development director or the community development director’s designee shall be an ex officio member of the commission. (Ord. 370 § 2, 2008)

2.74.030 Duties.

A. To utilize the “guidelines and toolkit” adopted by the city council to assist in the implementation of Chapter 17.63 SBMC, to assess view assessment applications and make definitive decisions on projects.

B. To provide a process to review all feasible solutions for development and choose that alternative which provides the best balance between the owner’s desire to develop his/her property in accordance with applicable regulations and the neighbor’s desire to protect his/her view. This chapter does not create a right to an unobstructed view. (Ord. 370 § 2, 2008)

2.74.040 Powers delegated to the view assessment commission.

Nothing in this chapter shall be construed as restricting or curtailing any of the powers of the city council, or as a delegation to the view assessment commission any of the authority or discretionary powers vested and imposed by law in the city council, except for the duties outlined in Chapter 17.63 SBMC.
